WHEREAS, Figures 5.3-6A, 5.3-5C, and 5.3-5g of the T.H. 10 Corridor <br />Management plan: T.H. 24 in Clear Lake to 1-35W, reflects that the proposed alignment <br />for a six-lane £reeway system through the City of Ramsey requires shifting the corridor to <br />the north so that it is adjacent to the Burlington Northern Santa Fe (BNSF) railroad <br />tracks; and <br /> <br /> WItEREAS, on May 13, 2003, the Ramsey City Council engaged the services of <br />The Tinklenberg Group to perform an Alternative Urban Areawide Review (AUAR) to <br />examine the proposed transportation alternatives and the subsequent impacts to properties <br />needed for construction; and <br /> <br /> WHEREAS, the City of Ramsey finds that an interim ordinance placing a <br />moratorium on the development, redevelopment or expansion of uses on certain parcels <br />located north 0fT.H. 10 and south of the Burlington Northern Santa Fe (BNSF) Railroad, <br />fi'om the eastern boundary to the western boundary of the City is necessary to protect the <br />planning process during the preparation of the AUAR. <br /> <br />SECTION 3. PROHIBITION <br /> <br />During the term of this Ordinance, notwithstanding Chapter 9 of the City Code, entitled <br />"Zoning and Subdivision of Land," no subdivision, rezoning, site plan approvals, <br />conditional use permits or variances of any kind shall be permitted, except that <br />applications for interim use permits for which no permanent or temporary building is <br />required may be considered. This prohibition shall not be applicable to routine <br />maintenance and upgrades to building exteriors, windows or interiors, as long as there is <br />not an expansion of the building. Except for those properties currently operating under <br />grandfather rights to the required site. improvements (pavement and curbing), the <br />moratorium would not exempt property owners from installing the required pavement <br />and curbing if they are developing or expanding their customer/employee parking areas <br />or outside display areas.
