CASE <br /> <br /> PUBLIC HEARING <br /> REQUEST FOR A CONDITIONAL USE PERMIT <br />FOR A SCHOOL LOCATED IN THE TOWN CENTER 3A SUBDISTRICT <br />By: Patrick Trudgeon, AICP <br /> Assistant Community Development Director <br /> <br />Background: <br /> <br />Academic Investments Inc. has submitted a site plan to construct a two-story, 71,350 square-foot <br />Charter School on Lot 1, Block 1 of the proposed Town Center subdivision. The Planning <br />Commission reviewed the site plan for the School on September 15, 2003 and recommended <br />approval. On September 22, 2003, the City Council approved the site plan subject to .the <br />applicant receiving a Conditional Use Permit in accordance with the Ramsey Town Center <br />Zoning District Ouidelines. <br /> <br />The following items are enclosed for your information: <br /> <br />a) Site location map <br />b) Site Plan <br />c) Adopted Town Center 3a Zoning District regulations <br />d) Proposed findings of fact <br />e) Proposed conditional use permit <br /> <br />Notification: <br /> <br />In accordance with State statute, Staff attempted to notify owners of property within 350 feet of <br />the Subject Property of the applicant's request and the public hearing. <br /> <br />Observations: <br /> <br />During the Planning Commission discussion of the School Site Plan, it was pointed out that the <br />applicant was unable to meet two of the standards contained in the TC-3 subdistrict, namely <br />Floor Area Ratio (F.A.R.) and "build to" setback requirements. The Planning Commission <br />directed staff to create a TC-3a district where schools would be conditionally allowed and that <br />had slightly different standards in regards to the F.A.R. and "build to" requirements. Staff <br />brought fbrward these changes to the City Council on September 23, 2003. At that meeting, the <br />City Council adopted the Town Center Zoning District which included the TC-3a District (A <br />copy of the TC-3a language is included with the case.) The approved site plan meets the new <br />requirements for the TC-3a subdistrict. <br /> <br />The TC-3a subdistrict requires that schools located in the Town Center must receive a <br />conditional use permit (CUP). In the Planning Commission site plan review, it was brought <br />forward by Staff that there were a few areas where the site plan did not meet all of the proposed <br />Town Center Draft Development Guidelines. It is the intent of this CUP to allow for these <br />deviations from the Guidelines based on findings to be adopted by the City. <br /> <br />73 <br /> <br /> <br />
