Councilmember introduced the following resolution and moved for its adoption: RESOLUTION #03-10- A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT TO ACADEMIC INVESTMENTS INC. TO CONSTRUCT A SCHOOL LOCATED IN THE TOWN CENTER 3A SUBDISTRICT AND DECLARING TERMS OF SAME: WHEREAS, Academic Investments, Inc., hereinafter referred to as the "Applicant," has properly applied for a Conditional Use Permit to locate a school in the Town Center 3a Zoning District property legally described as follows: Lot 1, Block 1, Town Center Addition, Anoka County, Minnesota once the plat is recorded. ("Subject Property") WHEREAS, the Planning Commission met on October 2, 2003, conducted the public hearing and recommended City Council approval of the request. NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: Based on Findings of Fact #__., a Conditional Use Permit (Permk) to construct a school in the TC3a subdistrict, is hereby granted to Academic Investments Inc., hereinafter referred to as the "Permittee". 2. That the Applicant is permitted to deviate from the Ramsey Town Center Development Guidelines in the following manner: a) Have less than 60% building transparency along Ramsey Blvd. b) Have less than 40% brick faCade along Ramsey Blvd. c) Have greater setbacks than stated in the Development Guidelines. d) Have more than 30% of public street devoted to parking along Ramsey Blvd. and Peridot St. 3. That the School building shall be properly constructed and maintained in accordance with all applicable Staff Review letters, approved site plans, City Code, and Un/form Building Codes. 4. That this Permit shall be perpetual in duration as long as the terms are herein complied with. 5. That the Permittee shall be responsible for all City costs incurred in administering and enforcing this Permit. 87
