He stated they want the opportunity for further review, have been <br />working closely with the developer, and have a strong comfort level. <br /> <br />Councihnember Cook stated he is very excited about this project since he has been watching the <br />PACT School and knows they have a unique way of looking at education and parent <br />involvement. He stated this has gone beyond being an experiment and to something that has <br />worked well in Anoka County so he is happy to see them in a permanent place in Ramsey. <br /> <br />Assistant Community Development Director Trudgeon noted the copy of the Secondary <br />Development Agreement, Section 1, Item 4, which obligates them to the agreement. He stated <br />that the rest of the document is the normal boilerplate agreement. He stated if the Council <br />approves the site plan, a contingency will be for them to enter into this development agreement. <br />He noted there was reference to the land across the street being used for recreational space by the <br />school, lie stated the school certainly needs recreational space but the question is whether the <br />City should accept that as park and give credit for it. He advised that issue will be discussed over <br />the next month. <br /> <br />Assistant Public Works Director Olson stated another issue is who owns the property. He <br />suggested a contingency be added to enter into an agreement with regard to the use of that open <br />space. <br /> <br />Mayor Gamec stated with other schools, the school owns the park and is responsible for the <br />upkeep. He stated his willingness to discuss it further but preferred that it remain under the <br />control of the PACT School. <br /> <br />Assistant Public Works Director Olson asked that the development agreement be amended to <br />add: "g. Contingent upon entering into an agreement with the City for use of and maintenance of <br />the open space on the west side of Peridot Street." The motion should also reference the letter <br />identified as part of the final plat since it specifically relates to these improvements that are <br />required by the developer. <br /> <br />City Attorney Goodrich stated Assistant Public Works Director Olson wants to make absolutely <br />certain that the City is not responsible for the construction of Peridot Street. So, he is <br />recommending that letter dated September 23, 2003, addressed to Ramey Town Center LLC, <br />identifying scope of services and cost estimates be included. <br /> <br />City Attorney Goodrich noted that Councilmember Kurak did not return to the Council dais to <br />participate in the discussion of this case. He explained that because of this letter, it affects the <br />entire Town Center tract that the Kurak family owns. He noted that Councilmember Kurak did <br />not realize that when she previously indicated that she would participate in this case. Thus, she <br />has decided to abstain from discussion on the PACT School. <br /> <br />Councilmember Cook asked if the agreement is part of the consideration tonight. <br /> <br />City Council/September 23, 2003 <br /> Page 30 of 41 <br /> <br /> <br />
