Presentation <br />Assistant Community Development Director Trudgeon advised that City Code states there shall <br />not be more than One main building on a lot unless otherwise provided for in City Code. Mr. and <br />Mrs. Edgerton have purchased the property at 7031 173rd Avenue NW. He explained the home <br />on the property was constructed in the very early 1900's, and the Edgertons are proposing to <br />demolish the homi~ and construct a new home on the property. They would like to live in the <br />existing home while the new one is being constructed. He stated for a temporary period of time, <br />there will be two homes on the property and the Edgertons have applied for an interim use permit <br />to allow this to happen while the new home is being constructed. <br /> <br />Assistant Community Development Director Trudgeon advised the applicants have stated that the <br />home has been inspected and no asbestos was found, lead paint levels were in an acceptable <br />range, and the contractor will be disposing of the mercury switch on the thermostat in accordance <br />with Minnesota POllution Control Agency (MPCA) regulations. He further advised the proposed <br />permit is drafted tO require that the new home be constructed within 6 months, that the applicants <br />take occupancy of[the new home within 30 days of issuance of certificate of occupancy, and the <br />existing home be' demolished and removed within 60 days of the issuance of certificate of <br />occupancy for the new home. He indicated in the event the weather conditions are not conducive <br />to backfilling the previous house foundation and septic system, the Building Official will have <br />the authority to grant a maximum 60 day extension. <br /> <br />Assistant Community Development Director Trudgeon advised the Interim Use Permit will <br />require the Applicants to post a $5000 surety bond at the City to ensure that the old home and <br />septic system are properly abandoned in a timely manner. He indicated Staff is recommending <br />approval of the Interim Use Permit. <br /> <br />Public Input <br />Motion by Chairperson Nixt, seconded by Commissioner Johnson to close the public hearing at <br />7:05 p.m. <br /> <br />Motion Carried. Voting Yes: Chairperson Nixt, Commissioners Johnson, Shepherd, Van Scoy, <br />and Watson. Voting No: None. Absent: Commissioner Brauer. <br /> <br />Commission Discussion <br />Commissioner Johnson asked if the Applicants have looked into a surety bond. <br /> <br />Mrs. Edgerton stated the builder, as part of their building plan, has set aside $5000 for the <br />demolition. <br /> <br />Motion by Chairperson Nixt, seconded by Commissioner Johnson to recommend that the City <br />Council adopt findings of fact relating to Mr. and Mrs. Edgerton's request for an Interim Use <br />Permit to maintain two dwellings on one parcel for a temporary period of time. <br /> <br />Motion Carried. Voting Yes: Chairperson Nixt, Commissioners Johnson, Shepherd, Van Scoy, <br />and Watson. Voting No: None.
