Commissioner Brauer indicated there seems to be a contradiction on whether machine shops are <br />allowed and Staff should review subd 4.a, b, c,d. <br /> <br />Community Development Director Frolik indicated on 10 acre parcels or larger, machine shops <br />are allowed. She noted, however, that items 6 and 9, and 7 and 10 seem to be duplicates, and <br />will be corrected before it goes to the City Council. <br /> <br />Ms. Moreland indicated 7 and 10 are similar, but not duplicates. She stated they would prefer <br />Staff keep 10 and not 7. <br /> <br />Chairperson Nixt noted one issue was having land without a dwelling, and he asked how that was <br />addressed. <br /> <br />Community Development Director Frolik read Subdivision 4A, where it deals with this issue. <br /> <br />Chairperson Nixt asked that they change the language from 'permitted' to 'may be permitted'. <br /> <br />Commissioner Brauer asked if this provided a solution to Mr. Menard, since it only allows a <br />permit to the current owner. <br /> <br />Community Development Director Frolik indicated each user would have to come in and request <br />a conditional use permit, and they would not be transferable. <br /> <br />Motion by Commissioner Johnson, seconded by Chairperson Nixt to recommend that the City <br />Council adopt the proposed Home Occupation Ordinance. <br /> <br />Motion carried. Voting Yes: Chairperson Nixt, Commissioners Johnson, Brauer, Shepherd, and <br />Watson. Voting No: Commissioner Van Scoy. Absent: None. <br /> <br />Commissioner Van Scoy indicated he feels they are tailoring something for one specific <br />individual, and he does not feel that is appropriate, nor does he feel it is appropriate to set up a <br />semi-commercial situation in a residential area. <br /> <br />Commissioner Johnson stated this is a situation is where Staff tried to bring everyone together. <br /> <br />Chairperson Nixt indicated while he agrees with Commissioner Van Scoy's comments, he thinks <br />they spent a significant amount of time sending this back for revisions until they came up with <br />something they could use. <br /> <br />Commissioner Brauer agreed, and thanked Staff for working on this. <br /> <br />Case #4 <br /> <br />Request to Rezone Property from E-1 Employment District to Planned Unit <br />Development (PUD); Case of Basalt Properties, LLP <br /> <br />Planning Commission/September 4, 2003 <br /> Page 7 of 20 <br /> <br /> <br />
