Councilmember Cook introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #03-08-217 <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT #0645 RELATING TO A <br />REQUEST FOR A CONDITIONAL USE PERMIT FROM GERALD AND KAREN <br />SCHMIDT TO ~EXCEED SIZE RESTRICTIONS FOR A DETACHED ACCESSORY <br />BUILDING ON PROPERTY FROM 14,880-43,559 SQUARE FEET. <br /> <br /> WHEREAS, Gerald and Karen Schmidt, hereinafter referred to as the "Applicants," have <br />properly applied for a Conditional Use Permit to exceed the size restrictions for detached <br />accessory buildings on properties from 14,880-43,559 square feet established in section 9.11.02 <br />"Accessory Uses" of City Code on the property generally known as 15243 Yakima St. NW and <br />legally described as follows: <br /> <br />Lot 2, Block 1, Gorhams Sandy Acres, Anoka County, Minnesota <br /> <br />("Subject Property") <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA that the findings of fact relating <br />to the request are determined to be as follows: <br /> <br />1. That the Applicants appeared before the Planning Commission for a public hearing pursuant <br /> to Section 9.03.04 of the Ramsey City Code on August 7, 2003, and that said public hearing <br /> was properly advertised and that the minutes of said public hearing are hereby incorporated <br /> by reference. <br /> <br />2. That the Subject Property is zoned R-1 Residential and is located within the Metropolitan <br /> Urban Service Area (MUSA). <br /> <br />3. That the Subject Property is approximately 37,000 square feet in size. <br /> <br />4. That City Code restricts the Subject Property to a total of 1,488 square feet of accessory <br /> building space. <br /> <br />o <br /> <br />That the Applicants have a primary garage of 624 square feet and a utility shed of 240 square <br />feet; the new !accessory building is proposed to be 1,080 square feet in size; resulting in a <br />total of 1,944 square feet of accessory building on the Subject Property. <br /> <br />6. That the Applicants have stated that the reason for the excess size of the proposed building is <br /> to store recreational vehicles and other personal property. <br /> <br />7. That the App'licants have stated that the detached accessory building will be utilized for <br /> personal storage and will not be used to facilitate a business. <br /> <br />8. That the construction of the detached accessory building will comply with all applicable <br /> Uniform Building Codes. <br /> <br /> <br />
