20) The violation of any of the material terms of this IUP is grounds for suspension or <br />revocation hereof, consistent with applicable law. Furthermore, the City specifically <br />reserves the right to amend, suspend or revoke this IUP consistent with applicable law as <br />reasonably required to protect the public health, safety and welfare and the environment. <br />Specifically, but without limiting the foregoing, the City may amend, suspend or revoke <br />this IUP consistent with applicable law if the City Council reasonably determines that <br />continued operation of the one -day events places the public health, safety, or welfare, or <br />the environment in jeopardy or creates a public nuisance due to noise or other nuisance <br />factors. <br />21) The City reserves the right to enter the Subject Property for the purposes of conducting <br />inspections and obtaining necessary information pertaining to the construction and <br />operational effect of the IUP or any related event. <br />22) All costs incurred by the City in administering and enforcing this permit shall be the <br />responsibility of the Permittee and shall be paid within thirty (30) days of billing by the <br />City. <br />23) The PERMITTEE shall be responsible for removal of all outdoor storage and debris <br />within 48 hours of conclusion of event. <br />24) That the IUP shall abide by all lease terns between the PERMITTEE and the City. <br />The motion for the adoption of the foregoing resolution as duly seconded by Councilmember <br />Elvig, and upon vote being taken thereon, the following voted in favor thereof: <br />Mayor Ramsey <br />Councilmember Wise <br />Councilmember Elvig <br />Councilmember Backous <br />Councilmember Jeffrey <br />Councilmember McGlone <br />Councilmember Tossey <br />and the following voted against the same: <br />None <br />and the following abstained: <br />None <br />and the following were absent: <br />None <br />whereupon said resolution was declared duly passed and adopted by the Ramsey City Council, <br />this the 31 day of May, 2011. <br />RESOLUTION #11 -05 -102 <br />Page 3 of 6 <br />
