Councilmember Wise introduced the following resolution and moved for its adoption: <br />-and- <br />RESOLUTION #10 -02 -059 <br />RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT FOR <br />THE OPERATION OF A HOT ASPHALT MIX PRODUCTION PLANT, BASED ON <br />FINDINGS OF FACT #0863, AND DECLARING TERMS OF SAME <br />WHEREAS, Tiller Corporation (the "Permittee ") has properly applied to the City of <br />Ramsey (the "City ") for a conditional use permit on the property generally known as 14100 Basalt <br />Street N.W. and legally described as follows: <br />Tract B Registered Land Survey No. 236, Anoka County, Minnesota <br />Outlot A Gateway North Industrial Park No. 5, except portion platted as Ebony Addition, <br />subject to easement of record, Anoka County, Minnesota <br />WHEREAS, . The City received a request from the Tiller Corporation to renew its <br />Conditional Use Permit and City Staff is recommending approval of this request. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />1) That the asphalt plant will be permitted to operate from April 1 through November 30 of each <br />year and this permit shall expire on March 1, 2015, but may be renewed by City Council without <br />a Public Hearing. <br />2) That the hours of operation shall be from 6:00 a.m. to 8:00 p.m. Monday through Saturday. Any <br />variance from these hours of operation shall require prior special approval by the City <br />Administrator or his/her designee. The City Council shall be notified of the temporary change <br />in hours. <br />3) That the operation of the asphalt plant and the emission of noise, odors, smoke, dust, fly ash or <br />other particulate matter from the site and operation shall be in compliance with and regulated by <br />the State of Minnesota Pollution Control standards. The Permit Holder shall have in effect at all <br />times during the term of this Permit, a Minnesota Pollution Control Air Emission Permit for a <br />hot mix asphalt plant. <br />4) That any stock piles of material shall be limited to a maximum height of 35 feet as measured <br />from the existing ground elevation over which it is placed and shall be located no closer than 20 <br />feet to any property boundary. <br />5) That crushing of demolition asphalt and concrete shall be conducted a minimum of one time per <br />year. <br />
