CASE #

REQUEST FOR SKETCH PLAN REVIEW OF TOWNHOUSES OF RUM RIVER
HILLS; CASE OF THOMAS ANDERSON AND WILBUR DORN
By: Zoning Administrator Sylvia Frolik

Background:

Thomas Anderson and Wilbur Dorn have submitted a sketch plan for "Townhouses of Rum River
Hills" which is Proposed so replat Lot 1, Block 2 and Outlot C, Rum River Hills, into 12
townhouse lots. The 12 units would be served by individual on-site septic systems and wells.

The property consists of approximately 4.5 acres and is zoned Planned Unit Development. (PUD).
The property is p}arl of a larger PUD, Rum River Hills, which was established to accommodate
development of single family homes and golf course.

The development agreement entered into for Rum River Hills did specify that Outlot C was
approved for devoJopment with multi-family housing at the time sewer and waI~:r b¢cgm~ i~vaitab)¢,
but it did not speoify to what density. There are plans on file that indicate density was proposed at
5-10 units per acre for a total of 18 to 37 units.

The following

a)
b)
c)
d)
e)
f)
g)
h)

i)
J)

items are enclosed for your review and information:

Site location map for Rum River Hills PUD
COpy of development ag-reement for Rum River Hills
Site location map for Townhouses of Rum River Hills
Sketch plan and supporting data for Townhouses of Rum River Hills
Leher from Dom and Edwards dated 8/5/92 to Sylvia Frolik
Le,t'ter from Sylvia Frolik to Wilbur Dom dat6d 9/21/92
Letter from Dom and Edwards to City Attorney William Goodrich dated 1/26/93
Example of letter from Dorn and Edwards to surrounding property owners dated
2/17/93
Leaer from Ronald Jerich to the Planning and Zoning Commission dated ~20/93
Letter from Steven Schwanke, Metropolitan Council, to Ryan Schroeder, City
Administrator, dated March 30, 1993.

Observations:

CiD' Staff raises the following concerns with the proposal:

a)

As of Decomber of 1989, the City has affirmed its commitment to Metro Council to adhere
to the 4 in 40 density policy. City Staff is very concerned that disregard for that
commitmegt and approving the platting of 12 townhouse house units on 4.5 acres in the
rural area Would jeopardize the City's on-goin, g efforts for a MUSA expansionCit3, Staff
has requelted written comments from Metro'..Council regarding the proposal for
Townhous~s of Rum River Hills.

It is also staff's position that the City has no previous commitment to the developers of
Rum RiverlHills as it relates to the 1989 affirmation of 4 in 40 density zoning because the
Rum River:Hills development a~eement specifically linked the higher density housing to
city sewer and water being available to the property.
