CASE # 5 <br /> <br />CONSIDER i CONDITIONAL USE PERMIT FOR LOTS 2, 3 AND 4, BLOCK 4, <br /> GATEWAY NORTH INDUST~ PARK PLAT tT2; <br /> CASE OF DANNY'S TRANNY'S, INC. <br /> By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />In May of this y~r, Dan Karst applied for a conditional use permit to disassemble engines and <br />transmissions an~ conduct wholesale activities on Lots 2, 3 and 4 of Block 4, Gateway North <br />Industrial Park Pl~t #2. Thc proposal included the construction of a 12,500 square foot building to <br />provide for an all.~nclosed operation. The site plan for the new construction was also approved by <br />City Council. <br /> <br />Observations: <br /> <br />Since the approvals of the conditional use permit mad site plan, operations relating to the aluminum <br />recycling activity ~ Lot 1 have extended onto Lots 2, 3 and 4. This extension of operations prior <br />to the consumction~ of the building and the outside storage of inoperable equipment, debris, and <br />feedstock preparation constitute violations of the conditional use permit issued for Lots 2, 3 and 4. <br /> <br />Pursuant to City Code Section 9.03.04 (Conditional Use Permits), the City Council conducted a <br />public hcahng on December 14, 1993 to review conditional use permit compliance and directed <br />City Stuff to draft ~mdings of fact Accordingly, findings of fact have been drafted and are <br />enclosed for Council review and adoption. <br /> <br />Since the pubhc hearing, the City has received letters from b°th Mr. Karst and his plant manager, <br />Sam Brady, stating~, their commitment to construct the building and conduct operations in <br />accordance with the ctondifional use permit. <br /> <br />The City Attorney has advised us that Section 9.03.04 of the City Code allows the City Council to <br />do only one of two things; revoke the conditional use permit based on the findings of fact or <br />continue the conditioaal usc permit and not revoke it Under the City Code, if the Council chooses <br />to continue and not ~evoke the conditional usc permit, a new revocation procedure would be' <br />necessary in the future should the permit holder not comply with the current conditional use permit <br />conditions. <br /> <br />The following items are enclosed: <br /> <br />a) <br />b) <br /> <br />c) <br /> <br />d) <br />e) <br /> <br />g) <br />h) <br />i) <br /> <br />Site location map <br />Conditional Use Permit issued to Danny's Tranny's, Inc. for Lots 2, 3, and 4, <br />Block 4~: Gateway North Industrial Park Plat #2 <br />"Update'on status of operations at Danny's Aluminum Processing which includes <br />sratemeats regarding condition of premises on Lots 2, 3 and 4. <br />Letter from Bob Brown of Production Design Products dated October 19, 1993 <br />Letter frq!m Sylvia Frolik to Dan Karst dat~ October 27, 1993 <br />lnspectiog report for November 9, 1993 b5 Sylvia Frolik <br />Luspecfio~ report for December 6, 1993 by Sylvia Frolik <br />Letter frown Sylvia Frolik to Dan Karst dated December 6, 1993 <br />Letter from Production Design Products dated December 8, 1993 <br /> <br /> <br />
