CASE # <br /> <br />WASTE <br /> By: <br /> <br />MANAGEMENT OF MINNESOTA, INC. <br />TIRE RECYCLING FACILITY <br /> Ryan Schroeder, City Administrator <br /> <br />Background: <br /> <br />As Council is aware, the Anoka Regional Sanitary Landfill closed on October 8, 1993. <br />Since that tirrle, there has been some discussion as to whether the conditional use permit for <br />the tire reeyoling facility expired at the same time. Opinions have varied. In any case, <br />however, it is~the Staff opinion that the CUP has in fact expired as of December 31, 1993. <br />This being the case, the manager of the landfill has expressed an intent to process and <br />remove al/remaining tires by the end of January 1994. <br /> <br />It has been th~ past practice of the City to allow for expiration of lapsing CUP's without <br />further Council action in cases where the holder of the CUP does not request a renewal or <br />extension. Therefore, unless directed otherwise, Staff intends to proceed under this <br />process. <br /> <br />To date, Staff has not yet been able to schedule a site visit with representatives of WMMI to <br />ensure that tir~ removal has, in fact, occurred. It is notable that WMMI has requested a <br />CUP to provicte for a temporary methane energy testing facility in generally the same <br />location as the 1'ecycling area. Further, with February action by the Planning Commission, <br />they hope to initiate this facility on or about March 1, 1994. <br /> <br />Given the above, Staff will be in contact with WMMI to ensure timely tire removal (if it <br />hasn't akeady occurred).
