CASE # CONSIDER CONDITIONAL USE PERMIT FOR LOTS 2, 3 AND 4, BLOCK 4, t GATEWAY NORTH INDUSTRIAL PARK PLAT g2; CASE OF DANNY'S TRANNY'S, INC. By: Zoning Administrator Sylvia Frolik Background: In May of this y~ar, Dan Karst applied for a conditional use permit to disassemble engines and transmissions an~t conduct wholesale activities on Lots 2, 3 and 4 of Block 4, Gateway North Industrial Park P~t #2. The proposal included the construction of a 12,500 square foot building to provide for an all~enclosed operation. The site plan for the new construction was also approved by City Council. ~ Observations: Since the approvals of the conditional use permit and site plan, operations relating to the aluminum recycling activity ~)n Lot 1 have extended onto Lots 2, 3 and 4. This extension of operations prior to the constmctioB of the building and the outside storage of inoperable equipment, debris, and feedstock preparation constitute violations of the conditional use permit issued for Lots 2, 3 and 4. Pursuant to City Code Section 9.03.04 (Conditional Use Permits), the City Council conducted a public hearing oniD~ecember 14, 1993 to review conditional use permit compliance and directed City Staff to draftifindings of fact. Accordingly, findings of were drafted and presented to City Council on Januar~y 1 g. Since the public h~aring, the City has received letters from both Mr. Karst and his plant manager, Sam Brady, starling their commitment to construct the building and conduct operations in accordance w~th th~ condiuonal use perrmt. On January 18, ~he City Council tabled action and directed Councilmembers Beyer and Zimmerman, City ~dministmtor Schroeder and Zoning Administrator Sylvia Frolik to meet with Mr. Karst and repo~ back to City Council with a recommendatiofi for action on January 25. The City Attorney has advised us that Section 9.03.04 of the City Code allows the City Council to do only one of tw~ things; revoke the con~fional use permit based on the findings of fact or continue the condifl~onal use permit and not revoke it. Under the City Code, if the Council chooses to continue and ndt revoke the conditional use permit, a new revocation procedure would be necessary in the fut~u'e should the permit holder not comply with the current conditional use permit conditions.
