CASE # <br /> <br />CONSIDER CONDITIONAL USE PERMIT FOR LOTS 2, 3 AND 4, BLOCK 4, <br /> t GATEWAY NORTH INDUSTRIAL PARK PLAT g2; <br /> CASE OF DANNY'S TRANNY'S, INC. <br /> By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />In May of this y~ar, Dan Karst applied for a conditional use permit to disassemble engines and <br />transmissions an~t conduct wholesale activities on Lots 2, 3 and 4 of Block 4, Gateway North <br />Industrial Park P~t #2. The proposal included the construction of a 12,500 square foot building to <br />provide for an all~enclosed operation. The site plan for the new construction was also approved by <br />City Council. ~ <br /> <br />Observations: <br /> <br />Since the approvals of the conditional use permit and site plan, operations relating to the aluminum <br />recycling activity ~)n Lot 1 have extended onto Lots 2, 3 and 4. This extension of operations prior <br />to the constmctioB of the building and the outside storage of inoperable equipment, debris, and <br />feedstock preparation constitute violations of the conditional use permit issued for Lots 2, 3 and 4. <br /> <br />Pursuant to City Code Section 9.03.04 (Conditional Use Permits), the City Council conducted a <br />public hearing oniD~ecember 14, 1993 to review conditional use permit compliance and directed <br />City Staff to draftifindings of fact. Accordingly, findings of were drafted and presented to City <br />Council on Januar~y 1 g. <br /> <br />Since the public h~aring, the City has received letters from both Mr. Karst and his plant manager, <br />Sam Brady, starling their commitment to construct the building and conduct operations in <br />accordance w~th th~ condiuonal use perrmt. <br />On January 18, ~he City Council tabled action and directed Councilmembers Beyer and <br />Zimmerman, City ~dministmtor Schroeder and Zoning Administrator Sylvia Frolik to meet with <br />Mr. Karst and repo~ back to City Council with a recommendatiofi for action on January 25. <br />The City Attorney has advised us that Section 9.03.04 of the City Code allows the City Council to <br />do only one of tw~ things; revoke the con~fional use permit based on the findings of fact or <br />continue the condifl~onal use permit and not revoke it.
