NOW~ THEREFORE, the CITY and DEVELOPER agree as follows: <br /> <br /> I. <br /> STAOE I IMPROVEMENTS AND FINANCIAL GUARANTEES <br /> <br />1. Ciiv Code Compliance. That the DEVELOPERS will develop the Plat in <br /> acbordance with the City Code, Section 9.50, entitled "Subdivision" and Section <br /> 9.20.31 entitled "Planned Unit Development". <br /> <br />2. Cctnformance with Plan. The Plat. shall be developed pursuant to the final <br /> pl~t consisting of two (2) sheets and dated received by the CITY on January 13, <br /> 19i)4. <br /> <br />3. Ineorvoration of All City Code Requirements. That the recitals above and <br /> th~ provisions of the City Charter, Subdivision Code, Zoning Code and Public <br /> Iml~rovement Code of the CITY as amended to date hereof, are incorporated herein <br /> by ~ference. <br /> <br />Staee I lmr~rovements Ret~uired. The DEVELOPER agrees to construct the <br />re~ired stage I Improvemgnts according to the terms and conditions of this <br />cofltract and in accordance with DEVELOPERS' plans submitted to the CITY. <br />Saigl plans shall be in general conformance with the plans prepared by Probe <br />Engineering and dated received by the CITY on April 20, 1990, and consisting of <br />Shaets 1 through 12 of 12. Grading shall not commence until the DEVELOPER <br />has}submitted the Tree Preservation and Planting Plan in accordance with Item #14 <br />of this agreement. <br /> <br />It i~, hereby agreed that the name of the proposed streets in the Plat may deviate <br />fro~ the City's grid pattern and be named 'Eurnberry Turn N.W. and Turnberry <br />Co~_ N.W.. It is also agreed that the right-of-way for said streets shall be at the <br />starldard sixty-six (66) feet but that the improved width shall be approved at 29 feet <br />andi that a variance to the 600 foot maximum length for dead-end streets is herein <br />gra~lted to Turnberry Turn N.W. <br /> <br />Boulevard and Area Restoration. The DEX, rELOPER shall be responsible <br />for {he cost of establishing seed or sod in ail boulevards with/n thh-'ry (30) days of <br />the ~ompletion of the street improvements, and restore all other areas disturbed by <br />the development grading operation in accordance with the approved erosion and <br />sediment control plan. The DEVELOPER shall also be responsible for the cost of <br />clea~ng any soil, earth or debris from the wetlands within and adjacent to this Plat <br />res~ting from ~m-ading performed in the development of the land. <br /> r <br /> <br />Reauirements after Street Surfacing,. After the street surfacing is installed, <br />the DEVELOPER shall clear any soil, earth, or debris from the streets and from <br />the ~ots within the Plat resulting from any consnmction on the Subject Property by <br />the .DEVELOPER or their successors and assigns. <br /> <br />Sta~e I Improvements - Comoletion Date. The Improvement completion <br />date~shaI1 be on or before August 31, 1994. <br /> : <br />Stage 1 Improvement Financial Guarantee. The DEVELOPER a~ees <br />and hnderstands that the CITY has the right, privilege and authority pursuant to <br /> <br /> <br />
