WHERI~AS, City Code Section 9.50.50 defmes "Stage I" Improvements and "Stage II" <br />Improvements w~eh defmifion is used herein when reference is made to "Stage I" and "Stage 11" <br />Improvements; and <br /> <br /> WHEREAS, the DEVELOPER B desires to consumct the Stage I and Stage II <br />improvements, eicept for those Stage II Improvements consumcted by the CITY; and <br /> <br />NOW, TI <br /> <br /> STAG] <br /> <br />1. <br /> <br /> [EREFORE, the CITY and DEVELOPERS agree as follows: <br /> <br /> I. <br /> g I IMPROVEMENTS AND FINANCIAL GUARANTEES. <br /> <br />Ci~iy Code Compliance. That DEVELOPER B will develop the Plat in <br />accordance with the City Code, Section 9.50, entitled "Subdivision" <br /> <br />cOnformance with Plan. The Plat. shall be developed pursuant to the f'mal plat <br />coar. sisting of one (1) sheet, prepared by Hakanson Anderson Associates, Inc., <br />entitled Rivenwick 2nd Addition and printed on November 29, 1993. <br /> <br />Ina_orv0ration or All City Code Reouirements. The <br />final construction plan for sanitary sewer, storm sewer, waterma.in, and street <br />imp~vements shall be submitted to the City Eng/neer for review and approval prior <br />to donstrucfion. The City Engineer shall have complete access and oversight <br />au~onty over all phases of construcnon of the project. Stage I Improvements shall <br />not be considered complete until accepted by the City Engineer. <br /> <br />Construction and Cost Sharing of Riverdale.Drive N,W, Although the <br />development of the Subject Property is not impaced by the construction of <br />Riv~dale Drive N.W., the agreement entered./nto for the development of Riverdale <br />Driee N.W. in the development agreement 'for Pdvenwick is herein recalled as <br />follows: Pdverdale Drive N.W. shall be conswacted in accordance w/th Municipal <br />Stat~} Aid specifications and in phases. Phase I shai1 be constructed to Municipal <br />Smt~ Aid specifications at the.expense of DEVELOPER A. The CITY agrees to <br />crecl~_t, in favor of DEVELOPER A, an amount equal to Twenty Percent (20%) of <br />the ~Ost o~' pavement, curb and gutter, storm sewer, and overhead, exclusive of the <br />valu,~ placed on the right-of-way ~ven toward future construction of Phase II <br /> <br /> <br />
