Section 8.2 ApPlication of Charter. g21 local improvement projects shall be carried out exclusively under the provisions of this cb, after. The to,wu ~:Iocai imr>rovement" as used in this Section shall mean a pubtic improvement financed pan!y or wholly from special assessments. .Section 8.3 Assessments for Services. ~e council may provide by ordinance that the cost of the city set, rices to streets, sidewalks, or other public-or pri,/are property may be assessed against propetT,/benefited and may be collected'in the same manner as special assessments. Sect/on 8.4 Loc,si Improvement Procedure. W'hen the city unde~akes any local improvement to which the state local in~r~rovement code applies, it 'sl~al./ comply with the provisions of that law, except as modified below. The council may bv ordinance prescribe the procedure to be followed in making any other local improvement and lex~'ing assessmems there fore. 8.4.1 Sixty Da}, Waiting Period. A period of sixty (60) days shall elapse a5er the conc{usion of the public hen.ring required by !aw to precede the ordering of the construction of a 1oc.5-I improvement project (the ~?ublic Hem'Lng") before the actual orde:-/n_~ ~ ~ ~h~ local imr~rovement b,/the council m~d the council emenn~ into a contract for the local improvement construction. -. 8.4.2 Petition Against the Local Improvement. If the proposed local inxprovement was initiated by petition of the owners of tJae real properq/, abutting on the streets named in the petition, and.if, within thirry (30) days of the conclusion of the public hoarding, a petition against such local improvement is filed with t~he city administrator and which petiuon is si~ed by a percentage of the owners of the real prope~? abutting on the streets named in the imtiaring petition as the location of the improvement which percentage is grsater than the percentage of owners who si~ed the initiate, rig petition, the council shall not make such local in?rovement at the expense of the said abutting property owners. -140-
