CASE <br /> <br />REQUEST FOR A CONDITIONAL USE PERMIT TO PROCESS DEMOLITON <br />CONCRETE IN THE E-2 EMPLOYMENT DISTRICT; <br /> CASE OF SAUTER AND SONS, INC. <br /> By: Patrick Trudgeon, AICP <br /> Assistant Community Development Director <br /> <br />Background: <br /> <br />Section 9.14 (Solid Waste) of City Code requires a conditional use permit for storage, collection, <br />transportation, treatment, utilization, processing, transfer, intermediate disposal and final <br />disposal of solid waste. City Staff defines demolition concrete as solid waste. Tom Sauter of <br />Sauter and Sons, Inc., is in the excavation and demolition business. Staff became aware that <br />demolition concrete is being stockpiled on their site at 6651 141st Avenue N.W. Pursuant to <br />Staff's request, Mr. Sauter applied for.a conditional use permit to stockpile demolition concrete <br />on his property for purposes of crushing it into an aggregate to be used on other job sites. <br /> <br />The following items are enclosed: <br /> <br />a) <br />b) <br />c) <br />d) <br />e) <br /> <br />Site location map <br />Site plan <br />Site photos <br />Proposed findings of fact <br />Proposed resolution to deny request <br /> <br />Notification: <br /> <br />In accordance with State Statute, City Staff attempted to notify owners of property within 350 <br />feet of the Subject Property of the request for permit and related public hearing. <br /> <br />Observations: <br /> <br />The Sauter property is zoned E-2 Employment and is approximately 11 acres in size. The <br />parcels to the north, south and west are also zoned E-2 Employment. The property to the east is <br />zoned E-1 Employment. <br /> <br />The applicant is in the demolition business and is requesting a permit from the City to stockpile <br />demolition concrete on site and crush it into aggregate for use on other job sites. The applicant <br />has submitted an amendment to their 2000 site plan that identifies a 70' x 120' area to be used <br />for stockpiling concrete rubble. They have stated that the stockpile height will be restricted to 10 <br />feet. The plan is to hire a crusher to come on the site once a year to reduce the concrete rubble <br />into aggregate for placement on job sites. It is anticipated that this could be accomplished in a 2- <br />day period. On a drive-by inspection on August 29, 2003, it appeared that demolition asphalt is <br />also being deposited on the stockpile. <br /> <br />The site plan does not identify any screening being added to the site. The original site plan <br />approved in January of 2001, included planting trees on the south, east and west property lines. <br /> <br /> <br />
