Counci hnember Srrommen introduced the following resolution and moved for its adoption: RESOLUTION #03-05-121 A RESOLUTION APPROVING SETTLEMENT OF PENDING LITIGATION WHEREAS, the City of Ramsey is the Petitioner in a condemnation action, which involves appeals from the icommissioners' award, docketed in Anoka County District Court as City of Ramse¥ v. Thomas} R. Kurak and Pattiann Kurak v. Richard Knutson, Inc. and Anoka County, Case No. C5-98~3541; and WHEREAS, representatives of the City and the Kuraks participated in a confidential court- ordered mediationrsession on May 2, 2003, for the purpose of reaching a negotiated settlement of the condemnation action among the parties; and WHEREAS, on July 22, 1998, the City issued two checks in an amount totaling $50,300 to the Kuraks; and WHEREAS, on November 7, 2000, the City issued a check in the amount of $44,700 to the Kuraks, resulting in payment of a total of $95,000, including $94,500 in compensation and $500 in appraisal fees; and NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Ramsey as follows: 1. That the proposed settlement, set forth in terms on Exhibit A attached hereto, is hereby approved. 2. That the Mayor and the City Administrator are authorized and directed to execute an appropriate settlement stipulation that incorporates the settlement terms on the attached Exhibit A, and to submit the s'ettlement stipulation to the Anoka County District Court for approval. The motion for the adoption of the foregoing resolution was fully seconded by Councilmember Elvig, and upon vote being taken thereon, the following voted in favor thereof: Mayor Gamec Councihnember Strommen Councilmember Elvig Councihnember Cook Councihnember Pearson Councilmernber Zimmerman and the following voted against the same: Nolle
