Counci hnember Srrommen introduced the following resolution and moved for its adoption: <br /> <br /> RESOLUTION #03-05-121 <br /> <br />A RESOLUTION APPROVING SETTLEMENT OF PENDING LITIGATION <br /> <br /> WHEREAS, the City of Ramsey is the Petitioner in a condemnation action, which involves <br />appeals from the icommissioners' award, docketed in Anoka County District Court as City of <br />Ramse¥ v. Thomas} R. Kurak and Pattiann Kurak v. Richard Knutson, Inc. and Anoka County, Case <br /> <br />No. C5-98~3541; and <br /> <br /> WHEREAS, representatives of the City and the Kuraks participated in a confidential court- <br />ordered mediationrsession on May 2, 2003, for the purpose of reaching a negotiated settlement of <br />the condemnation action among the parties; and <br /> <br /> WHEREAS, on July 22, 1998, the City issued two checks in an amount totaling $50,300 to <br />the Kuraks; and <br /> <br /> WHEREAS, on November 7, 2000, the City issued a check in the amount of $44,700 to the <br />Kuraks, resulting in payment of a total of $95,000, including $94,500 in compensation and $500 in <br />appraisal fees; and <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Ramsey as <br />follows: <br /> <br /> 1. That the proposed settlement, set forth in terms on Exhibit A attached hereto, is <br />hereby approved. <br /> <br /> 2. That the Mayor and the City Administrator are authorized and directed to execute an <br />appropriate settlement stipulation that incorporates the settlement terms on the attached Exhibit A, <br />and to submit the s'ettlement stipulation to the Anoka County District Court for approval. <br /> <br />The motion for the adoption of the foregoing resolution was fully seconded by Councilmember <br />Elvig, and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />Mayor Gamec <br />Councihnember Strommen <br />Councilmember Elvig <br />Councihnember Cook <br />Councihnember Pearson <br />Councilmernber Zimmerman <br /> <br />and the following voted against the same: <br /> <br />Nolle <br /> <br /> <br />
