CASE # <br /> <br /> REQUES~ FOR FINAL PLAT APPROVAL OF PINEWOOD SHADO'6~S, <br /> ;% MINOR SUBDIVISION; CASE OF GERALD BAUER <br /> By: Zoning Administrator Sylvia Frolik <br /> <br />Background: } <br />Mr. Gerald Bau~er is requesting a minor subdivision to create one 3.0 acre lot and one 37 acre lot <br />from a 40 acre ~arcel lying southeast of Whispering Pines Estates Plat 2. <br />The following ~r~ms are enclosed for your information: <br /> <br /> a) ~ite location map <br /> b) l~roposed final plat <br /> c) Certificate of survey for Lot 1, Block 1 <br /> d) ~ty Staff review letter dated February 14, 1994 <br /> e) l~roposed resolution granting final plat approval <br /> f) lh'oposed development agreement <br /> <br />Observations{ <br /> <br />The property isizoned R - 1 Rural Residential and the split is intended to separate the existing <br />homestead fron. the remaining 37 acres, which will be reserved for future development. The <br />extent of the fu ute development will depend on the outcome of the City's request at the Metro <br />Council for a M .ISA expansion. The proposed minor subdivision is in compliance with the current <br />4 in 40 density ~gularions. <br /> <br />Both of the lots vould receive access from the existing Puma Street N.W. Because Puma Street is <br />currently a dirt ~oadway, it was Staffs recommendation that the 37 acre parcel be designated as an <br />outlot to preveflt the creation of an additional buitdable lot and more traffic on a dirt street. In <br />addition, this iection of Puma Street is anticipated to be a future MSA collector street. <br />Accordingly, th~ developer has provided a sufficient amount of fight-of-way to accommodate an <br />80 foot right-of-~vay. <br /> <br />tn accordance v,~,"th City Code, no park dedication will be due on the existing 3 acre homestead nor <br />the unbuildable buflot- <br /> <br />The Planning ~ommission reviewed the sketch plan for Pine Shadows on February 1 and <br />recommended a~proval of the subdivision contingent upon the developer providing documentation <br />to support that ~e homestead on Lot 1 will meet all required setbacks from the proposed property <br />lines. On Febr~ry 10, the City received the proposed final for Pine Shadows and a certificate of <br />survey for Lot 1 ~that verifies that all structures on the homestead meet the setback requirements. <br /> <br />Recommendation: <br />City Staff and ~e Planning Commission recommends approval of the minor subdivision. <br /> Counci!
