REVIEW POLICY OF ALLOWING NON-INTOXICATING <br />ALCOHOLIC BEVERAGES IN CITY PARKS <br /> By: Mark Boos, Parks/Utilities Coordinator <br /> <br />Case #1 <br /> <br />Background: <br /> <br />For several years City Council has granted a temporary permit to allow non-intoxicating alcoholic <br />beverages at Central Park for the commtmiD, picnic. The review of this policy is before the <br />Commission to provide an opportunity to comment on the issue. <br /> <br />It is expected that the Ramsey Lions Club, the primary sponsor of the community picnic, wilt <br />request a sales permit hq late spring of this year. <br /> <br />Observations: <br /> <br />It is believed that the primary, pohcy issue at hand is whether the City's condoning this element of <br />the picnic conflicts with other ideals, most notably D.A.R.E. 02Yrug Abuse Resistance Education). <br />It should be further noted that Staff is unaware of any complaints related to the provision of non- <br />intoxicating malt liquors, or charges of being antonymous, but the possibility of a perceived <br />conflict has been pointed out. <br /> <br />Approximately one year ago, CiD, Staff collected our neighboring City's ordinances relating to this <br />issue. The Ciu of Anoka states in their City Code 24-2I--I "Gamblmg, excessive use of alcoholic <br />beverages, and abusive, boisterous, profane or indecent language, conduct, or attire is prohibited <br />in public parks. No alcoholic beverages shall be possessed or consnmed in the parks where notice <br />of such restriction is posted." The City of Andover states in Ordinance 47 Section 2 <br />"Consumption or possession of alcoholic beverages is not allowed in Ci~, parks unless a p:rmit is <br />obtained under Section 2.3A .... An exclusive use permit may be approved by the Ci~ Council <br />and issued by the CiD, Clerk for the selling of food and alcoholic or non-alcoholic beverages as set <br />forth by Ci~, Resolution." The City. of Coon Rapids in Chapter 10-416 Section 1 and 2 states "No <br />person shall bring, have in his possession, or consume alcoholic beverages at any time in a.ny park <br />except as provided in Sub-section 2." Sub-section 2 reads ['Consumption o{ non-intoxicating <br />alcoholic beverages is permitted in parks ff purchased from a person licensed to sell in such park <br />pursuant to the provisions of City Code 5-209. It has been <br />Civ policy to disallow an5' alcoholic beverages in CiV parks.
