CASE # J <br />REQUEST F~R EXTENSION TO INSTALL REQUIRED SITE IMPROVEMENTS <br />AND~ WAIVER OF FINANCIAL GUARANTEE REQUIREMENT; <br /> CASE OF DALLES R.V. <br /> By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />As you may re, all, in the Fail of 1992, Daltes R.V. was proposing to relocate from 7129 Hwy. <br />#10 N.W. to 7103 Hwy. #10 N.W. At the time, conditional use permits were required for outside <br /> <br />display areas an, <br />areas, were requ <br />use permit to Df <br />conditional use' <br />and a financial ~ <br />Code. Accordin <br />at the City in the <br />of the improvem¢ <br /> <br />[, outside display areas in addition to driveways and customer/employee park/ng <br />red to be paved and curbed. In November of 1992, the City issued a conditional <br />.les R.V. for the outside display area at 7103 Hwy. #10 N.W. The terms of the <br />:rmit required pavement and curbing, a deadline for installing the improvements <br />m.rantee ensuring the installation of the improvements, in accordance with City <br />[ly, Mr. Da/les Notermann, owner ofDalles R.V., placed the financial guarantee <br />form of a letter of credit hq the amount of $47,868.00, I50% of the estimated cost <br />.nts, and the conditional use permit was issued. <br /> <br />Observations: <br /> <br />Mr. Notermann d <br />the expiration tat{ <br />were not complet <br />daughter called to <br />that time, it was cc <br />installed to date to <br />request a Council <br />that the letter of cr <br /> <br />d not meet the October, 1993 deadline for installing the improvements. When <br />on the letter of credit approached, the issuer was notified that the improvements <br />and the letter must be renewed. The issuer notified Da/les Notermann and his <br />protest the required site improvements and the required f'mancial guarantee. At <br />mmunicated that their options were to request an inspection of the improvements <br />reduce the amount of the £mancial guarantee to be provided, and in the meantime <br />:xtension to install the site improvements. It was never meant to be conveyed <br />· ,dlt could lapse, but Da.lies R.V. took no adtion to renew it, and it did expire. <br /> <br />Because of additio ml improvements to be made to the building at 7103 Hwy. #10 N.W., Dalles is <br />requesting that the ~ime period for installing the required site improvements be extended from i993 <br />to 1997 and that n~Tmancial guarantee be required. Da/les is willing to let his Motor Vehicle Sales <br />l/cerise serve as his ~ommitment to complete the required site improvements. <br /> <br />In recent years, tho Council has held steadfastly to requiring the installation of the requ/red site <br />improvements and ~roviding financial guarantees. <br /> <br />The following item.q are enclosed for your review: <br /> <br /> a) Site location map <br /> b) Approved site plan <br /> c) Con~fiona] Use Permit <br /> d) Letter from Da/les R.¥. dated January 11, 1994 <br /> <br />Recommendationi <br /> <br />It is important for tha City to preserve its credibility in this case in recognition of those commercial <br />developments that h~ve come before you in the past that were made to comply with requirements <br />and those commerci~il developments that will come to you in the future from which you will desire <br />the same performanc~ standards. <br /> <br /> <br />
