I I I I I ~ STATE OF MINNESOTA ~ DEPARTMENT OF TRANSPORTATION LANDscAPE PARTNERSHIP PERMIT AND AGREEMENT A Permit is hereby ~ranted by tile State of Minnesota, Department of Transportation ("Department"), to the City of Ramse¥ ("~ty"), for the purpose of installing and maintaining various landscaping features on the right of way of Trunlc Highway No. 10 & 169 and 47 ("Lands"), as shown on the exhibit attached hereto and made a part of this permit a~nd in accordance with the special provisions listed below. This pemfit is gran~d under the terms of the 'Community Roadside Landscaping Partnership Program' of the Minnesota DepartmC. nt of Transportation. The program is intended to allow beautification and landscape enhancement of Stat~ right of way through cooperative effort of the Minnesota Department of Transportation and local units of government. The local unit of government acts as the sponsor or responsible agency under file terms of this pe~t and may enlist the assistance of others to fulfill its responsibilities. In this project, the City of Ramse¥ is tile responsible local unit of government. The following Special Provisions apply to this project: This permit~and agreement is granted only for the purpose of conducting the folIowing activities within tile right of~way of Highway .10 & 169 and 47 as shown on the attached exlfibit. -Plantin~ si~ preparation -Installatio~of all Mn/DOT furnished plant material which includes spreading of woodchip mulch. -Perpetual n~aintenance, repair, and replacement of planting areas. Use of the ~reas shall in no way impair or interfere with the safety or convenience of the traveling public in itsiuse of the highway. Maintenanca and replacement responsibilities .qhall include those features which were provided and/or installed by ~e Minnesota Department of Transportation and shall be performed in accordance with the attached list~ and calendars of required maintenance activities (Tables la, lb, 2a, 2b, 3, 4 and 5.) Tiffs permit ~nd agreement is non-exclusive and is granted 'subject to the rights of others, including, but not limited t~ public utilities which may occupy the right of way. The City wiil preserve and protect all utilities located on the lands covered by this permit and agreement ai no expense to the Minnesota Department of Transportation. As required ~y statute, the City. is required to notify Gopher State One Call System (1-800-252-1166) at least 48 hours before any digging on this project.
