,I
I
I

WILBUR F, DORN,,JR.
ROE~ [RT EDWARDS

DORN & EDWARDS, LTD.
AT"I'ORNEYS AT LAW

FAX 15IZ}

February 17, 1993

Mr. and Mrsi Ronald Jerich
Ramsey, MN ~55303

Dear Mr. and Mrs. Jerich:

When Rgm River Hills was developed by Dr. Tom Anderson and
myself, it ~as done as a "Planned Unit Development" (PUD) ~nder
the City's PUD ordinance. This means that a variety of land uses
(residential, commercial, recreational) were created, and the
development~was done in phases. One of the yet uncompleted
phases concerns a 3.7 acre tract (Outlot C) which lies south
of the thir~ fairway, and just north of where 169th Avenue meets
Iodine Street.

I
I

I
I
I
I
I

I This tract was approved for higher-density multiple-family
housing tobe developed when central sewer and water became
available. ~The lot was laid out to accomodate a'single~row'
of condominiums or apartments along the third fairway,'served
by a singlelprivate access road. About 40 condominiums or apart-
ments could! be constructed on this parcel.

In the'past year we began exploring the possibilties of
developing this parcel using a private sewer and water system.
However, in, bringing the subject up to some of the residents,
we heard widespread opposition to the concept of multiple-
family dwei~ings. Some people indicated that they were not
even aware ~hat this parcel had received approval for this usage,
even thoughlthat information has been public knowledge since
1984. ~

We have held this property for nine years, paid the taxes,
and the condominium plan was an integral part of our overall
expected re~urn. The retail value of an approved condominium
plat would ~e somewhere in the area of $600,000. It is apparent
to us, howe~er, that whether we use a private treatment plant,
or wait for!the metro sewer line to be extended this far north,
many of the!neighbors will still object to the idea. However,
we have already performed our end of our arrangement with the
City. 'We d~nated the land for the golf course to the City, and
the City in~ turn was' able to reconvey it to the Golf Course oper-

'"'C~VrL TRIAL SP'.[¢IALIST
C~RTIFIr'D I~.Y THE.
