Counciln~mb~ <br />adopnon: <br /> <br /> A RESOI <br /> WILLIA~ <br />ESTABLISH <br /> <br /> introduced the following resolution and moved for its <br /> RESOLUTION g94-03- <br /> <br />iUTION ADOPTING FINDINGS OF FACT # RELATING TO <br /> DUBATS' REQUEST FOR A CONDITIONA'L--13SE PERMIT TO <br /> AND OPERATE A SELF-SERVICE STORAGE FACILITY IN THE <br /> B-3 HIGHWAY BUSINESS DISTRICT <br /> <br /> WHEREAS, William Dubats, hereinafter referred to as "Applicant", has prop,erly applied <br />for a Conditi0~al Use Permit to establish and operate a self-service storage facilit3 in the B-3 <br />Highway Busin{:ss Dismct on the property legally described as follows: <br /> <br /> Lot 3, B!ock 3, RIVERSIDE WEST, Anoka Count3', Minnesota <br /> <br /> "the Sulsject Property" <br /> NOW ~HEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF RA~IVlSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br /> That the ~pplicant appeared before the Planning Commission for a public hearing pursuant <br /> to Seetio~ 9.03.04 of the Ramsey City Code on March 3, 1994, and that the public hearing <br /> was propjerly advertised and that the rmnutes of said pubhc hearing are hereby incorporated <br /> by referehce. <br /> <br />That the ,~ubject property is approximately 50,000 square feet or 1.15 acres in size. <br /> <br />That the subject property is zoned B-3 Highway Business. <br /> <br />That the i~djacent properties to the south and west are zoned R-1 Urban Residential and <br />Park; andl-the properties to the north and east are also zoned B-3 Highway Business. <br /> <br />That the spbject proper'fy is located within the Critical River Overlay District. <br /> <br />That acc0rdin~ to R~msey City Code Section 9.20.23 (B-3 Highway Business), self- <br />service storage facilities are not a perrmrted use in that dismct. <br /> <br />That t.h~e ~pplicant also owns and or>erates self-service storage facilities on Lots 1 and 2. <br />Block o, l;[iverside West, for which conditional use permir~ were =m-anted in 1986 and <br />1987. <br /> <br />That the ~ppiicant is proposing to consn-uct three (3) self-service storage facilities on the <br />su~ect pr¢perry, two (2) of which are proposed to be 6,800 square feet each in size and the <br />th/rd strnc!ure is proposed to be 5,100 ~uare feet in size, for a total of 18,700 square feet. <br /> <br />10. <br /> <br />11. <br /> <br />12. <br /> <br />That SectiPn 9.21.07 (Critical River Overlay District Development Standards) of the City <br />Code resters the impervious surface area to 30% of the lot or 15,000 square feet in this <br />case. <br /> <br />That acco ~.rglin~ to the site plan submitted dated'February 2, 1994. Revision Februm-v 25, <br />1994 C, aPproXimately 90% of the subject property will 5>e developed w/th an impervious <br />surface arm; this exceeds the 30% resmcrion established by Section 9.21.07 of the City <br />Code. ~ <br /> <br />That the APplicant has properly applied for a variance to Section 9.21.07 (Critical River <br />Overlay Di[mct Development Standards). <br /> <br />That in 1986, a variance was g-ranted for Lot 2, which is also in the Critical River Overlay <br />Dismct, to .be developed with an impervious surface area measuring 85% of the lot. <br /> <br />III <br /> <br /> <br />
