of documents by the Perminee to support that, the Site is current on all property taxes, <br />assessments and'all City, fees and charges; and ~_~ the Permit-tee supplying the City with a <br />maintenance guarantee to ensure the survival of the plantings. <br /> <br />Said maintenance guarantee shall consist of cash or a letter of credit, approved as to form <br />bv the C/ty, in the amount of Two Thousand and Twenty Five Dollars and No Cents <br />(~2,025.00) and shall be in effect for a two (2) year period commencing on the date of City <br />approval of said tree plantings. <br /> <br />At the end of the two year period and upon ~q-itten verification by the City that all trees <br />planted in accordance with the approved landscape plan have either survived or have been <br />replaced, the maintenance guarantee shall be returned to the Perminee. in the event the <br />Permittee fails to replace any required tree'planting, the City may complete the required <br />planting w/th City day labor and/or by letting contracts for said completion and draw upon <br />the maintenance guarantee for payment. The Permittee hereby grants permission and a <br />license to the Cit.',' and/or its contractors and assigns to enter upon the Site for the purpose <br />of completing the plantings in the event of Permittee's default. <br /> <br />DETENTION VOLUME AND CEMENT <br />REIMBURSEMENT CONSIDERATIONS. <br /> <br />CURBING AND <br /> <br />The Site is in the Critical River Overlay District and the amount of impervious surface area <br />is substantially resmcted to prevent the pollution of the Mississippi River by surface water <br />runoff. The Perm/nee herein agrees to construct a detention volume on the Site that will <br />consist of a trench lined with cement block to substa_nrially reduce the discharge of surface <br />water runoff from the Site into the area storm sewer system, tn consideration of the <br />additional cost incurred by the Permittee to develop the site in a manner that will meet the <br />intent of the Critical River Overiav District development standards, the CiB, herein agrees to <br />reimburse the ?ermirtee for a po~on of detention volume construction costs. <br /> <br />CiD' Code requires that continuous 6 inch concrete curbing be installed around the <br />pen. meter of the bituminous sm-face on the Site. Accordingly, 6 inch continuous concrete <br />curbing shall iy~ installed along the east property line ad. iacent to Ebony Street N.W. l=or <br />access purposes, the cement curbing has been waived along the north property line. Ir is <br />herein a~eed that 6 inch curbing along the south and west property lines may funcrionallx, <br />impede the approved drainage plan for the Site. The Permittee herein a~ees to install a <br />cement border along the south and west property lines to maintain the primary purpose of <br />cement curbing which is to strengthen the bituminous edge. In consideration of the <br />aclci~tional cost incurred to install cement borders where curbing may be considered more of <br />a hindrance than an asse~ the Ci~, herein agrees to reimburse the Permittee ~or a portion of <br />the costs therein. <br /> <br />The City herein agrees to reimburse the Permittee for a portion of the costs incm-red for <br />detention volume and cement curbing in the mount of One Thousand One Hundred Eighg, <br />Dollars and Forty-Six Cents ($1,180.46) per year for ten (10) years contingent upon the <br />Required Site Improvements being constructed and installed as required herein and <br />presentation of documents by the Permit'tee each 3'ear to support that the Site is current on <br />all property taxes, assessments and City fees and charges. <br /> <br />FIRE LANES. Fire lanes shall be mainta/ned on the Site. The exact location of these <br />items on the Site shall be as directed by the City's Fire Chief. <br /> <br />LIGHTING. Any lighting installed on the Structures or in the parking lot shall be <br />designed so as to deflect hght away from Ebony Street N.W. and adjacent residential uses. <br /> <br /> <br />
