You mentioned <br />that it was your understanding that State statutes requires that both of the parcels <br />resulting! from the subdivision must be at least 20 acres in size in order to <br />accompl~h the subdivision by a metes and bounds description. In reviewing State <br />statute aind our local ordinance with City Attorney Bill Goodrich, we have <br />determin{xt that the clause that requires both of the resulting parcels to be at least 20 <br />acres in s,'jze has somehow been erroneously omitted from City Code. <br /> <br />However, Ramsey's City Code and State statue also permits the conveyance of <br />propertyI by metes and bounds description if compliance with the platting <br />regulatidns presents an unnecessary hardship and failure to comply does not <br />interfere[with the purposes of the chapter. It is staffs opinion and recommendation <br />to City Qo. uncil that in lieu of the fact that the subject property: <br /> <br /> 1,) is located in Ramsey's highest ~owth area; <br /> is anticipated to be brought into the MUSA in the very near future; <br /> ~ and <br /> 3.,) is being conveyed to a developer for platting purposes; <br /> <br />that: <br /> <br /> 11.) to require a minor plat to convey the property to the developer for <br /> platting purposes is an unnecessary hardhsip; and <br /> 2) the purpose of the conveyance is to facilitate the platting of the <br /> property which is in compliance with the purposes of Ramsey's <br /> subdivision chapter. <br /> <br />The proi~osed resolution for City Council consideration on April 12 to permit the <br />metes add bounds subdivision will be recommended for amendment to specifically <br />respondl to the hardship and compliance with purposes of subdivision chapter <br />criteria. 7 <br /> <br /> <br />
