FAMILY AND MEDICAL LEAVE <br />By: Kay McAloney, Administrative <br /> <br />ACT POLICY <br />Services Manager <br /> <br />CASE # <br /> <br />Background: <br />The Family and Medical Leave Act of 1993 (FMI..A) gives many workers a specific right to take <br />such a leave of absence without jeopardizing their jobs. The FMLA generally went into effect on <br />August 5, 1993. For workers covered by a union contract in force on that date, the law's <br />provisions went into effect on the date the contract expires or February 5, I994, whichever is <br />earlier. To comply with the FMLA, employers must prepare a written policy and post a notice <br />informing employees about their leave rights. A draft policy is attached for you to review. <br /> <br />Private employers with 50 or more employees are covered employers. State and local governments <br />are also covered employers. Employees are eligible to take family and medical leave if: they work <br />for an covered employer, have been working for the employer at least 12 months before the leave <br />request; and have worked at least 1,250 hours during that time. <br /> <br />Family and medical leave does not cover all critical events within family life. The specific events <br />which trigger family and medical leave is when: <br /> <br />a son or daughter is born to the employee; <br />a son or daughter is placed with the employee for adoption or foster care; <br />the employee is needed to care for a seriously ill spouse, son, daughter, or parent; <br />or <br />the employee has a sgrious health condition. <br /> <br />The FMLA does not diminish our obligation to comply with any employment benefit program but <br />was designed to establish minimum standards.
