AN ORDINANCI~ AMENDING CHAPTER 7, SECTION 7.61 ENTITLED "LAWFUL GAMBLING" OF!THE CITY CODE OF RAMSEY, MINNESOTA The City of Ramsey ..Ordains: SECTION 1. This Ordinance is adbpted pursuant to the authority granted by Minnesota Statutes, Chapter 349. et al, SECTION 2. A~VI~ ENDMENT [ Section 7.61 of the ~ty Code is mended to mad as follows: 7.61.01 PUrpose I The purpose !of thxs section is to regulate and control the conduct of lawful gambling pursuant to the provisionts of Chapter 349 of Minnesota Statutes. 7.61.02 P~doption of Reference Chapter 349 Of Minnesota Statutes is adopted by reference the same as if fully set forth herein. 7.61.03 Notice; Approval or Disapproval The applicat)t for a lawful gambling premises permit ("premises permit") within the City shall apply to the ~ouncil in writing in the manner required by law for a premises permit at least 60 days before issu~g or renewing the premises permit. Each application for a premises permit shall be approved or ~lisapproved by the Council. 7.61.0 4 Iaoeation Lawful gambling under license issued by the Minnesota Gambling Control Board ("Board") may be conducte~ only at locations that comply with applicable zoning, building, fire and health codes of the City. ~I1 applications must be for a specific location with the exception of Class D (raffle only) licenses. The following locations are considered unsuitable for gambling operations and any request for a premises perknit at such a location will be rejected without clear and convincing evidence that such a location Will not pose undue enforcement difficulties, lessen property values of adjoining properties, o!' expose gambling to persons under 18 years of age: a. ; Arca~ s zoned for agriculture or residential use;.. Locations where the predominant clientele is under the age of 18 years.
