ORDINANCE #94. <br /> <br /> CITY OF RAMSEY <br /> ANOKA COUNT <br /> STATE OF MINNESOTA <br /> <br />AMENDMENT '~O CHAPTER 7 WHICH IS KNOWN AS THE LICENSING AND <br />PERMITS CHAP] ER OF THE CITY CODE. <br /> <br />AN ORDINANCI~ AMENDING CHAPTER 7, SECTION 7.61 ENTITLED "LAWFUL <br />GAMBLING" OF!THE CITY CODE OF RAMSEY, MINNESOTA <br /> <br />The City of Ramsey ..Ordains: <br /> <br />SECTION 1. <br /> <br />This Ordinance is adbpted pursuant to the authority granted by Minnesota Statutes, Chapter 349. et al, <br /> <br />SECTION 2. A~VI~ ENDMENT <br /> [ <br />Section 7.61 of the ~ty Code is mended to mad as follows: <br /> 7.61.01 PUrpose <br /> <br /> I <br /> The purpose !of thxs section is to regulate and control the conduct of lawful gambling pursuant to <br /> the provisionts of Chapter 349 of Minnesota Statutes. <br /> <br /> 7.61.02 P~doption of Reference <br /> <br /> Chapter 349 Of Minnesota Statutes is adopted by reference the same as if fully set forth herein. <br /> 7.61.03 Notice; Approval or Disapproval <br /> <br /> The applicat)t for a lawful gambling premises permit ("premises permit") within the City shall <br /> apply to the ~ouncil in writing in the manner required by law for a premises permit at least 60 days <br /> before issu~g or renewing the premises permit. Each application for a premises permit shall be <br /> approved or ~lisapproved by the Council. <br /> <br /> 7.61.0 4 Iaoeation <br /> <br /> Lawful gambling under license issued by the Minnesota Gambling Control Board ("Board") may <br /> be conducte~ only at locations that comply with applicable zoning, building, fire and health codes <br /> of the City. ~I1 applications must be for a specific location with the exception of Class D (raffle <br /> only) licenses. <br /> <br /> The following locations are considered unsuitable for gambling operations and any request for a <br /> premises perknit at such a location will be rejected without clear and convincing evidence that such <br /> a location Will not pose undue enforcement difficulties, lessen property values of adjoining <br /> properties, o!' expose gambling to persons under 18 years of age: <br /> <br />a. ; <br /> <br />Arca~ s zoned for agriculture or residential use;.. <br /> <br />Locations where the predominant clientele is under the age of 18 years. <br /> <br /> <br />
