CASE # 4 <br /> <br />REQUEST I~OR A CONDITIONAL USE PERMIT TO EXPAND AN OUTDOOR <br /> RECREATIONAL FACILITY IN THE INDUSTRIAL DISTRICT <br /> ~ By: Zoning Administrator Sylvia Frolik <br /> <br />Background:~ <br /> <br />Ty Ritter of KRIS Investments has purchased theoutdoor recreational facility formerly known as <br />Cheap Thrills. ~he facility is located on Lot 2, Block 1, HY-10 Ramsey, just west of the Brooks <br />store on ArmstrOng Blvd. <br /> <br />Observations: <br /> <br />The subject property is located in the Industrial District and Mr. Ritter is proposing to expand the <br />recreational facility by the addition of batting cages. Thc use is in the Industrial District because of <br />a conditional Use permit issued by the City in t988 and the conditional use permit process is <br />required in orde/' to expand or enlarge upon the use. <br /> <br />There is sufficient area remaining on the property to install batting cages without encroaching on <br />required off-street parking. The former property owners defaulted on the requirement to pave 69 <br />off-street parking spaces and KRS Investments is willing to fulfill that commitment. Mr. Ritter <br />originally prop6sed a 2-phase project which consisted of paving 25 parking spaces in 1994 and 44 <br />spaces in 1995.[ This proposal for off-street parking improvements was accepted by the Planning <br />Commission. <br /> <br />However, subsequent to the Planning Commission meeting, the investors have indicated that <br />because of the ~apital outlay projected for other landscaping and property improvements slated for <br />1994, they are t, equest/ng that all paving be allowed for installation by October 30, 1995 and that <br />the number of iequired parking spaces be reduced from 69 to 30. This October 30, 1995 date is <br />the deadline prpposed for the 2nd phase of off-street parking improvements under the ori~nal <br />proposal. The/.equest for a reduction in the nunber of required parking spaces is based on the fact <br />that the previo6s owner proposed 69 parking spaces in order to accommodate the roller skating <br />rink that was al~o intended to be developed on the site. <br /> <br />A financial gu~antee ensuring the improvements to the off-street parking area will be required to <br />be deposited ~ith the City prior to the issuance of the conditional use permit. The financial <br />guarantee will!remain in effect until the off-street parking improvements are installed to the <br />satisfaction of the City. <br /> <br />For the record, ~ere were no verbal or written comments submit-ted at the public hearing conducted <br />by the Planning Commission on April 5.
