Councilmember <br /> <br />introduced the following resolution and moved for its adoption: <br />RESOLUTION g'94-04- <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT # RELATING TO A <br />REQUEST FOR A CONDITIONAL USE PERMIT TO ~AND AN OUTDOOR <br />RECREATIONAL FACILITY IN THE INDUSTRIAL DISTRICT <br /> <br /> WHEREAS, KRS Investments, dba Smiley's, hereinafter referred to as "Applicant", has <br />properly applied for a Conditional Use Permit to expand the outdoor recreational facility in an <br />Industrial District to include batting cages on the property generally known as 14622 Ferret St. <br />N.W. and legally described as follows: <br /> <br />Lot 2, Block I, HY-10 RAMSEY, Anoka County, Minnesota <br /> <br />(the "Subject Property") <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF RAMSEY, ANOKA COUNTY~ STATE OF MINNESOTA, as follows: <br /> <br />That the Applicant appeared before the Planning Commission for a pubiic hearing pursuant <br />to Section 9.03.04 (Conditional Use Permits) of the Ramsey City Code on April 5, 1994 <br />and that said public heating was properly advertised and that the minutes of said public <br />hearing are hereby incorporated as a pan of these findings by reference. <br /> <br />2. That the subject property is zoned Industrial and is approximately 4.2 acres in size. <br /> <br />That the adjacent properties to the north and west are also zoned Industrial and the adjacent <br />property to the east and the property on the south side of Hwy. #10 N.W. is zoned B-3 <br />Highway Business. <br /> <br />That on April 26, 1988, the City Council issued a conditional use permit to the Subject <br />Property for the establishment of an outdoor recreational facility in the Industrial Disubct <br />that would include miniature golf, go-cart track, bumper boats and roller fink. <br /> <br />That the Applicant is proposing to expand the outdoor recreational use by the addition of <br />batting cages. <br /> <br />That the Applicant has submitted a copy of the original site plan for the facility which <br />indicates an area for batting cages that will not encroach on the 69 off-street parking spaces. <br /> <br />9. <br /> <br /> 10. <br /> <br />That the Applicant has stated that they will fulfill the commitments of the prior property <br />owners and install required site improvements to the off-street parking area (bituminous <br />surfacing and concrete curbing) over the next 2 year period. <br /> <br />That access to the recreational facility will continue to be from Ferret St. N.W. <br /> <br />That the proposed use will increase traffic to and from 'fine subject property. <br /> <br />That the proposed use wilI not be unduly dangerous or otherwise detrimental to existing or <br />future neighboring uses. <br /> <br /> <br />
