T~he only City streets designated as haul roads for the operation shall be Ferret Street N~W. north of 147th Avenue N.W. and 147th Avenue N.W. between Ferret Street N.W. an~t Armstrong Blvd. N.W. The Permit Holder shall provide access from the site to the City [treet at a single point and a 50 foot length of crushed gravel shall be placed from this point into the site to minimize tracking dirt residue onto the City streets. All mining operations shall be conducted between 6:30 a.m. and 8 p.m. on weekdays only unless otherwise specifically approved by the City Administrator and/or his designee. The amojJnt of dust or other particulate matter caused by the mining operation shall not exceed tt~e standards established by the Minnesota Pollution Control Agency. No operation shall be allowed when wind gust exceed 30 miles per hour. All oper~ttions shall comply with all applicable Minnesota Pollution Control Agency regulations and Federal and Environmental Protection Agency regulations for the protection of water qluality. All haul ~oads are subject to the approval of the City Engineer. While hauling operations are in progress, the permit holder shall maintain the haul road in a condition satisfactory to the City ~ngineer. When hauling operations are completed, the permit holder shall either restore t~at haul road to a condition at least equal to that which existed at the time the hauling ~perations were started, or compensate the local road authority in an amount satisfacto~ to that road authority and concurred in by the City Engineer for the restoration of that ha~ul road. The City Engineer will then accept such restoration or concur in such financial ~ettlement for the restoration of the haul road in writing and such acceptance will relieve th~ permit holder of any additional obligation in connection with the restoration of the haul rbads. If the permit holder fails or refuses to perform haul road restoration or to make satisfactory financial settlement for such restoration, the City will cause the restoratio~n work to be done and require reimbursement from the financial guarantee required l~erein.
