Kurtz, 643 F.3d 264 (8th Cir. 2011) <br />The U.S. Court of Appeals, Eighth Circuit, has jurisdiction over Arkansas, <br />Iowa, Minnesota, Missouri, Nebraska, North Dakota, and South Dakota. <br />EIGHT CIRCUIT (MISSOURI) (06/28/11)—This case addressed the issues <br />of: (1) whether a consent judgment entered into between a county and a cell <br />tower applicant violated state law by compelling issuance of permits without <br />following county land use regulation procedures; and (2) if so, whether the <br />consent judgment remained valid as "necessary" to correct a violation of fed- <br />eral law (the Telecommunications Act of 1996). <br />The Background/Facts: In 2008, St. Charles Tower, Inc. ("St. Charles") <br />applied for a conditional use permit ("CUP") to build a cell phone tower <br />in Franklin County, Missouri (the "County").
