'~ <br /> <br />This Ordinance ia adopted pursuant to the authority granted by Minnesota Statutes, Chapter 349. et <br />al. <br /> <br />SECTION 2. AMENDMENT <br /> <br />Section 7.61 of the City Code is amended to read as follows: <br /> <br />7.61.01 Purpose <br /> <br />The purp0~se of this section is to regulate and control the conduct of lawful gambling <br />pursuant tO, the provisions of Chapter 349 of Minnesota Statutes. <br /> <br />7.61.02 :Adoption of Reference <br /> <br />Chapter 349 of Minnesota Statutes is adopted by r~ference the same as if fully set forth <br />herein. <br /> <br />7.61.03 Notice; Approval or Disapproval <br /> <br />The applic[tnt for a lawful gambling premises permit ("premises permit") within the City <br />shall apply!to the Council in writing in the manner required by law for a premises permit at <br />least 60 da~Ys before issuing or renewing the premises permit. Each application for a <br />premises p~rmit shall be approved or disapproved by the Council. <br /> <br />7.61.04 Location <br /> <br />Lawful gambling under license issued by the Minnesota Gambling Control Board <br />("Board") r~ay be conducted only at locations that comply with applicable zoning, building, <br />fire and he41th codes of the City. All applications must be for a specific location with the <br />exception oi' Class D (raffle only) licenses. . <br /> <br />The follow'.~g locations are considered unsuitable for'gambling operations and any request <br />for a prem~es permit at such a location will be rejected without clear and convincing <br />evidence thitt such a location will not pose undue enforcement difficulties, lessen property <br />values of a4joining properties, or expose gambling to persons under 18 years of age: <br /> <br /> a. : Areas zoned for agriculture or residentiaI use; <br /> <br /> <br />
