b. i Locations where the predominant clientele is under the age of 18 years. <br />7.61.05 ~ Conditions <br /> <br />The condt~ct of lawful gambling under license issued by the Board shall be subject to the <br />following ~:onditions in the City: <br /> <br />a. A~opy of any lease agreement between a non-profit organization and a gambling <br /> loc~ation owner or operator shall be filed with the Administrator together with the <br /> prehfises permit application; <br /> <br />b. Th~ Council may refuse to issue a premises permit for a location in which gambling <br /> violations have previously occurred, and the Council may refuse to issue a lawful <br /> gat~bling premises permit to a non-profit organization which has previously <br /> violated terms of this Code and/or Minnesota Statutes, Chapter 349. <br /> <br />c. Thei maximum number of gambling devices at any one location in the City shall be <br /> limlted to two of any one type of device. The maximum number of each gambling <br /> devic, e may be operated by any one or more than one organization holding a <br /> premxses permit at any one location. <br /> <br />7.61.06 Investigation <br /> <br />Every organization which files an application for issuance or renewal of a premises permit <br />shall deliver' the application to the Administrator. The Administrator shall investigate each <br />application land report any findings and recommendations to the Council. <br /> <br />7.61.07 Filing of Records; Inspections; Access to Records <br /> <br />Subd. 1 .Every orgamzauon holding a prermses permit to conduct lawful gambling ~n the <br /> Citylshall file with the Administrator copies of all records and repons required to be <br /> filed~,, with the Board pursuant to Minnesota Statutes, Chapter 349 and the rules and <br /> regulations promulgated thereunder. The records and reports shall be filed in the <br /> offide, of the Administrator on or before the day they are required to be filed with the <br /> Board; <br /> <br />Subd.2.Eve~ gambling event in the City conducted by an organization under Minnesota <br /> Statfites, Chapter 349 shall be open to inspection by officers of the Rarnsey Police <br /> DepOnent; <br />Subd.3.The Administrator or employees of the Police Department, at the direction of the <br /> Adm/~mstrator, may inspect at any reasonable time, without notice or search <br /> warr$nt, all records of an organization holding a premises permit in the City, <br /> inclu~ting gambling account and other bank records required by the Board to be <br /> main¢ined and preserved. <br /> <br />7.61.08 F':ee <br /> <br />The City will charge all new applications the maximum investigation fee permitted by <br />Minnesota ~itatutes, Chapter 349 in order to coyer'costs incurred investigating the <br />application. ~Any unused portion of this fee will be refunded to the applicant. This fee does <br />not apply tO; applications for renewal of premise permits or additional sites for an <br />organization Currently holding a premises permit in the City. <br /> <br /> <br />
