b. i Locations where the predominant clientele is under the age of 18 years. 7.61.05 ~ Conditions The condt~ct of lawful gambling under license issued by the Board shall be subject to the following ~:onditions in the City: a. A~opy of any lease agreement between a non-profit organization and a gambling loc~ation owner or operator shall be filed with the Administrator together with the prehfises permit application; b. Th~ Council may refuse to issue a premises permit for a location in which gambling violations have previously occurred, and the Council may refuse to issue a lawful gat~bling premises permit to a non-profit organization which has previously violated terms of this Code and/or Minnesota Statutes, Chapter 349. c. Thei maximum number of gambling devices at any one location in the City shall be limlted to two of any one type of device. The maximum number of each gambling devic, e may be operated by any one or more than one organization holding a premxses permit at any one location. 7.61.06 Investigation Every organization which files an application for issuance or renewal of a premises permit shall deliver' the application to the Administrator. The Administrator shall investigate each application land report any findings and recommendations to the Council. 7.61.07 Filing of Records; Inspections; Access to Records Subd. 1 .Every orgamzauon holding a prermses permit to conduct lawful gambling ~n the Citylshall file with the Administrator copies of all records and repons required to be filed~,, with the Board pursuant to Minnesota Statutes, Chapter 349 and the rules and regulations promulgated thereunder. The records and reports shall be filed in the offide, of the Administrator on or before the day they are required to be filed with the Board; Subd.2.Eve~ gambling event in the City conducted by an organization under Minnesota Statfites, Chapter 349 shall be open to inspection by officers of the Rarnsey Police DepOnent; Subd.3.The Administrator or employees of the Police Department, at the direction of the Adm/~mstrator, may inspect at any reasonable time, without notice or search warr$nt, all records of an organization holding a premises permit in the City, inclu~ting gambling account and other bank records required by the Board to be main¢ined and preserved. 7.61.08 F':ee The City will charge all new applications the maximum investigation fee permitted by Minnesota ~itatutes, Chapter 349 in order to coyer'costs incurred investigating the application. ~Any unused portion of this fee will be refunded to the applicant. This fee does not apply tO; applications for renewal of premise permits or additional sites for an organization Currently holding a premises permit in the City.
