REQUEST F£ }R A CONDITIONAL USE PERMIT FOR A HOME CASE OF DIANE DEMPSEY By: Zoning Administrator Sylvia Frolik CASE # ~ OCCUPATION; Background: ~ Diane Dempsey, !a soon to be resident of 14794 Krypton Court N.W., has applied for a conditional use permit for a t~ome occupation. Diane would like to transfer her porcelain doll-making classes from her home in' Maple Grove to her new home in Ramsey. The following items are enclosed for your information: a) b) c) d) e) f) Si :e location map il~plicants letter of application :e plan Fl. >or plan Prvposed findings of fact Prbposed conditional use permit Observations: The Planning C6mmission conducted a public hearing on May 3 and there were no verbal or written comments submitted. In accordance with the City's regulations for home occupations, the area devoted to the business would not exceed 20% of the total floor area of the home. The employees would be restricted to the residents of the home. The driveway is marginally large enough to provide a sufficient amount of off-street paring for the students. In order to avoid the need for on-street parking, Diane indicates in her le!ter of application that she would restrict the class size to 6 students and many of the students would continue to car pool. At this time, she is proposing 4, 2.5-hour classes, 3 evenings and 1 afiernoon, per week. It should be noted that Diane's home is the first to be developed on Krypton Court N.W. Therefore, her futhre neighbors will not have had the opportunity to comment on the request for a home occupanon'as the hearing notices were mailed to the developer of Wood Pond Hills 3rd Addition, the curr.~nt owner of the surrounding parcels. Recommendation: In lieu of the site location being an urban size lot in the Urban Residential District, and in lieu of the absence of neighl:/prs to comment on the request, City Staff is recommending that an interim use permit be grantec~ to accommodate the classes for approximately one year after Diane takes occupancy of thehome. At the end of one year, the classes should be relocated to an appropriate commercial location or Diane should request converting the interim use permit to a conditional use permit. City comlideration to convert the interim use permit to a conditional use permit would require a new publ!ic hearing by the Planning Commission and a decision of the City Council. Council Action: Adopt Resblution//94-05- dopting Findings of Fact # lating to a request for a home occupation permit at 14794 Krypton Court N.W.
