E( UES FOR <br /> CASE <br /> By: <br /> <br />CASE <br /> <br /> A VARIANCE TO CUL-DE-SAC LENGTH; <br /> OF GOOD YALUE HOMES, INC. <br />Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />As you recall, 0n March 22, 1994, Chesmut Ridge was granted final plat app. roval with Kr~ton <br />Street N.W. being constructed as a through street, contingent upon DNR granung a pen~fit to cross <br />wetland #2-11 z~p. <br /> <br />Observatlons; <br /> <br />Good Value Hd~nes has received notification from DNR that their request for a permit to cross the <br />wetland has beech denied. <br /> <br />On May 24, 1~94, the developer approached City Council for a revision to the final plat to <br />construct Krypi, on Street N.W. as a cul-de-sac that exceeds the 600 foot maximum length by <br />approximately 8[00 feet. Staff informed City Council that it was still possible to construct Krypton <br />Street N.W. as~ through street by bridging the wetlan~ Bridging the wetland would not require <br />DNR permittinl~, however, it would jeopardize the City s chances of getting a permit in the same <br />proximity to cr4ss the wetlands in order to extend Sunwood Drive. The Developer indicated that <br />even if there wd, re City participation in funding, bridging the wetland was cost prohibitive for the <br />creation of 13 ldts and requested a variance to cul-de-sac length. <br /> <br /> · <br />Another opnon i~)resented to Council on May 24, 1994, was that of appealing DNR's decision to <br />deny the permi[request. This option was not acceptable to the Developer, City Staff or City <br />Council as the lengthy process would prohibit development in 1994 and it is not likely that the <br />appeal would ~ approved; and if it were approved, it would have an adverse impact on obtaining <br />the permits necessary to extend Sunwood Drive. <br /> <br />In accordance kith the Subdivision Chapter of City Code, on June 6, 1994, the Developer <br />approached the Planning Commission for a recommendation on a variance to maximum cut-de-sac <br />length. <br /> <br />The following n~ms are include for your information: <br /> <br /> a) Site location map <br /> b) ~oposed plat with through street <br /> c) ~oposed plat with cul-de-sac <br /> d) ~oposed findings of fact <br /> e) 1~ oposed variance <br /> f) .l:~roposed resolution granting revised final plat approval <br /> <br />Recommendation: <br /> <br />The Planning C(~mmission and City Staff recommend approval of the variance to cul-de-sac length <br />and revised fina~l plat approval of Chesmut Ridge to design Krypton Street N.W. as a cul-de-sac <br />versus a throug[ street. <br /> <br /> <br />
