1(1. <br /> <br />That o~a May 24, 1994, the Rarnsey City Council advised thc Applicant to approach the <br />Planning Commission for 8 variance to cul-de-sac length in accordance with Section <br />9.50.30 (Subdivision Design Stanchards), Subsection 9.50.08 (Variances). <br /> <br />11. <br /> <br />12. <br /> <br />I3. <br /> <br />14. <br /> <br />15. <br /> <br />That .ott June 6, 1994, thc Planning Commission was advised that DNR had denied thc <br />pcrnm :request to fill a portion of Wetland ~4t2-114P in order to construct Krypton Street <br />N.W. a, a through street. <br /> <br />That or. June 6, 1994, the Planning Commission was also informed that bridging Wetland <br />#2-I 14Pis a second alternative to constructing Krypton Street N.W. as a through street, <br />but it ca ,uld adversely impact the City's opportun/ty to obtain a permit to cross the wetlands <br />in that ~ame proximity in order to extend Sunwood Drive as planned. <br /> <br />That thc Applicant has stated that bridging the wefland is cost prohibitive for the creation of <br />13 lots.i <br /> <br />That tha, special condition causing the undue hardship is the fact that the Subject Property is <br />surroun~lLed on three sides by wetland and this condition does not result from the actions of <br />the Applficant. <br /> <br />That by!mason of physical conditions, namely Wetland #2-1 t4P and County Ditch No. 43, <br />strict cOjnpliance with the requirements of cul-de-sac lengths will cause exceptional and <br />undue hhrdship to the development of the Subject Property. <br /> <br />16.
