(ii) Liability of the City shall be governed by the <br /> provisions of the Municipal Tort Claims Act, <br /> Minn. Stat. ch. 466, and other applicable laws. <br /> <br /> (7) T~rm. The term of this Agreement shall be for three <br />years beginning April 1, 1994 and ending on March 31, 1997. On or <br />before Octo]er 1, 1996, AEC shall inform the City of any changes <br />to the rate for the various billing services which will become <br />effective i~ this Agreement is renewed. <br /> <br /> (87 T~rmination. Either party may terminate this Agreement <br />for the othe~ party's failure to perform its obligations under this <br />Agreement, ~rovided that the other party has failed to cure any <br />failures tolperform its obligations after having received thirty <br />(30) days w~itten notice identifying a failure to perform. <br /> <br /> (9) T:'a~sfer of Records. Upon the expiration of the term of <br />this Agreem~':nt, or sooner, termination of this Agreement pursuant <br />to paragrap~ II(5) above, AEC will make available to City, at AEC's <br />expense, it~ records and data collected in the performance of this <br /> <br />Agreement s~ as to enable the City or any s~bsequent contractor to <br />perform ~hel Services described herein. The records and data <br />described h~rein shall be in the form of computer software and/or <br /> <br />hard copies. <br /> <br /> (10) U~lawful Discrimination Prohibited.
