Councilmember ~ i RESOLUTION #94-06-_ RESOLUTION~ RECEIVING PETITION COUNTERING PROJECT #9445 (STREET LIGHT IMPROVEMENT FOR ESTATES 2NDiADDITION) introduced the following resolution and moved for its adoption: IMPROVEMENT GREEN VALLEY WHEREAS, on April 12, 1994, the City Council received a petition and ordered a feasibility stud), to[consider the improvement of street lights to Green Valle3, Estates 2nd Addition (Improvement Proji:ct ff94-15); and WHEREAS, on Ma3, 24, 1994, the City Council conducted a public hearing for Improvement Projeict fi)4-15 at which several residents expressed opposition; and WHEREAs, in accordance with City Charter Chapter 8, Public Improvements and Special Assessmen~ts, the affected parties have 30 days to petition against said public improvement. Such petition mus! by signed by a percentage of affected owners greater than the percentage of owners who signed the initiating petition; and WHERE4S, on June 9, 1994, the City received a petition countering Improvement Project g94-15; and~ WHEREA~, the City Administrator has found the petition to be of the correct percentage of lawful signaturel; of affected property owners, and to be in accordance with the City Charter and Minnesota Statuteslconceming local improvements. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: 1) That a certgin petition countering Improvement Project g94-15 (the improvement of street lights to Green Valley Estates 2nd Addition) has been filed with the City Council on June _8, 1994. iThe pennon ~s hereby declared to be signed by the required percentage of affected pr,~perty owners. This declaration is made in conformity to City of Ramsey Code Section 4.60 and Minnesota Statute Chapter 429. 2) That in accordance with City Charter Chapter 8, Public Improvements and Special Assessment:s, the affected parties have 30 days (from the filing with the City Administrator of the peri!ion against Improvement Project #94-15) with which to file with the City Administra~tor a petition in favor of the local improvement. Such petition must by signed by a percer}tage of affected owners greater than the percentage of owners who signed the petition against the public improvement.
