AGREEM_ENT CITY WIDE GARAGE DOOR COMPANY, INC. ANrD CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA The City of Ramsey hereby agrees to issue a temporary permit to Ivan G. Ctauson, the President of City Wide Garage Door Company, inc. (the "Permit Holder") for the placemenl of a temporary office structure at 6845 Hwy. #10 N.W. (the "Subject Property"). This temporaU, permit is allowed for issuance on the understanding that Permit Holder will apply for and obtain an Interim Use Permit for the placemem of a temporary office structure on the Subject Property dunng fire damage repairs. It is herein agreed that the application will be submitted to City Staff in a time frame that will accommodate presentation of the application to the Planning Comrmssion on July 5, 1994 and the City Council on July 12, 1994. in the event the application for the Interim Use Permit is denied bv City Council, the Permit Holder agrees to have the temporary office structure removed from the Subject Property by Jul), 19, 1994. It is also understood that this temporary permit for a temporary office structure at 6845 Highway #I0 N.W. will not be issued until the City has received from the Permit Holder a financial guarantee in the amount of Five Hundred Dollars and 00/100 (S500.000) in a form acceptable to the City. Said guarantee shall be maintained in an escrow account in the name of the Permit Holder. The purpose of the guarantee is to ensure that the temporary office structure will be removed from the Suj~ct Property b), 3u)y 19, 1994, if the City Council denies the application for an Interim Use Permit. The City shall have the authority to draw upon the financial guarantee in the event the Permit Holder fails to act in accordance with the terms of this ag-reement. Failure to remove the temporagj structure by July 19, 1994 if the Interim Use Permit is denied shall result in forfeiture of the financial guarantee in favor of the City. Upon City Council approval of the Interim Use Permit, the financial guarantee shall remain in effect at the City of Ramsey to guarantee timely removal of the temporarf, office structure in accordance with the terms of the interim Use Permit issued by tbs City.
