Councilmember introduced the following resolution and moved for its <br />adoption: <br /> <br /> RESOLUTION #94-0?- <br /> <br /> A RESOLUTION ADOPTING FINDINGS OF FACT # RELATING TO <br /> REBECCA! JACKSON'S REQUEST FOR A CONDITION'~-~USE PERMIT TO <br /> MAINTAIN AN ACCESSORY APARTMENT IN A SINGLE FAMILY <br /> DWELLING UNIT IN THE R-1 RURAL RESIDENTIAL DISTRICT <br /> <br /> WHEREAS, Rebecca Jackson, hereinafter referred to as "Applicant", has properly <br />applied for a COnditional Use Permit to maintain an accessory apartment in a single family dwelling <br />unit in the R-1 :Rural Residential District on the property generally known as 15720 Kangaroos <br />Sn'eet N.W. and legally described as follows: <br /> <br />CITY <br /> <br />Lot 4, Block 8, WHISPERING PINES ESTATES PLAT 3, Anoka County, Minnesota. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />That the: Applicant appeared before the Planning and Zoning Commission for a public <br />hearing pursuant to Section 9.03.04 of the Ramsey City Code on July 5, 1994, and that the <br />public heating was properly advertised and that the minutes of said public hearing are <br />hereby incorporated by reference. <br /> <br />2. That the subject property is approximately two (2) acres in size. <br /> <br />That the Subject property is zoned R-l Rural Residential. <br /> <br />That the surrounding properties are also zoned R-1 Rural Residential. <br /> <br />o <br /> <br />That according to Ramsey City Code Section 9.20.11, the R- 1 Rural Residential District is <br />intended for single family dwelling units. <br /> <br />That the Applicant is proposing to lease the lowest level of the 3-level split as a one (1) <br />bedroom accessory apartment with its own kitchen and bath facilities. <br /> <br />That there are other similar permitted conditional uses in the single farnily district. <br />That the prOposed use will not adversely impact traffic in the area. <br /> <br />10. <br /> <br />That the proposed use will not be dangerous or detrimental to persons residing or wortdng <br />in the vicinity. <br /> <br />That the Proposed use will not substantially or adversely impair the use, enjoyment or <br />market valise of surrounding properties. <br /> <br />11. <br /> <br />That the pgoposed use will be maintained in order to be harmonious in appearance with the <br />existing an~ intended character of the R-I Rural Residential District. <br /> <br />12. That the proposed use will be adequately served by essential public services. <br /> <br />13. <br /> <br />That the proposed use will not create excessive additional requirements at public cost for <br />public facilities and services. <br /> <br />14. <br /> <br />That at the public heating, at least one neighbor spoke out in opposition to the proposed <br />use. <br /> <br /> <br />
