*Councilmember <br /> <br />introduced the following resolution and moved for its adoption: <br />RESOLUTION #94-07- <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF AN INTERIM USE PERMIT <br />FOR AN ACCESSORY APARTMENT IN A SINGLE FAMILY STRUCTURE IN <br />THE R-1 RURAL RESIDENTIAL <br /> <br /> WHER:EAS, Rebecca Jackson has properly applied for a conditional use permit <br />("Permit") to maintain an accessory apartment within the single family dwelling in the R-] Rural <br />Residential District on the property generally known as 15823 Nowthen Blvd. N.W. and legally <br />described as follows: <br /> <br />Lm 4, Bl'ock 8, WHISPERING PINES ESTATES PLAT 3, Anoka County, Minnesota <br /> <br /> WHEREAS, the Planning Commission met on Jul2,' 5, 1994, conducted the public <br />hearing and recommended City Council approval of the request, but in the form of an interim use <br />permit. <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />Based on_Findings of Fact # , an interim use permit (the "Permit") for an accessory <br />aparmqent within the single family dwelling upfit is hereby granted to Rebecca Jackson, (the <br />"Permit Holder"), at 15720 Kangaroo Street N.W. (the "Subject Property"). <br /> <br />o <br /> <br />That said~ Permit shall remain in effect so long as the conditions imposed herein are <br />complied ;with and Rebecca Jackson maintains ownership of the Subject Property and <br />residency ~n one of the two units on the Subject lh'openy. <br /> <br />3. That the structure exterior shall maintain the appearan, ce of a single family dwelling unit. <br /> <br />That the structure shall not be further altered to render it marketable as a duplex or the <br />accessory ,panment as a condominium. <br /> <br />That the accessory apartment shall be reswicted to a one (1) bedroom unit and is approved <br />for occupancy by a maximum of two (2) persons. <br /> <br />That all occupants of the dwelling and accessory apartment shall be provided with off-street <br />parking. <br /> <br />That the Permit Holder herein a~ees to absolve the City from any and all obligation <br />associated with the issuance of this conditional use permit as a result of the intensified use <br />of the property. <br /> <br />That the Permit Holder herein a~ees to accept all responsibility for maintaining the <br />accessory apartment in accordance with applicable building and fire codes. <br /> <br />o <br /> <br />10. <br /> <br />That the Permit Holder and/or property owner shall be responsible for all City costs <br />incurred in administering and enforcing this Perrrfit. <br /> <br />That the Cit3, Adminisn-ator, or his/her designee, shall have the right to inspect the premises <br />for compliar~ce and safety purposes annually or at any time, upon reasonable request. <br /> <br />The motion for the.adoption of the foregoing resolution was dui3, seconded by Councilmember <br /> and upon vote being taken thereon, the following voted in favor thereof: <br /> <br /> <br />
