WHEREAS, the DEVELOPER intends to cause the construction of the following <br />improvements in the Plat without financial participation on the part of the CITY, to-wit: Sanitary <br />sewer, storm ~ainage facilities, watermains and appurtenances, and sn-eets with concrete curb and <br />gutter, which, improvements are termed Stage I Improvements in the City Code ("Stage I <br />Improvements"); and <br /> WHEREAS, no expenditure of CITY funds will be made until the City Code escrow <br />requirements have been completed by DEVELOPER; and <br /> <br />NOW, THEREFORE, the CITY and DEVELOPER agree as follows: <br /> <br />STAGE I IMPROVEMENTS AND FINANCIAL GUARANTEES <br /> <br />City Cgde Compliance. That the DEVELOPER will develop the Plat in accordance <br />with the City Code, Section 9.50, entitled "Subdivision. <br /> <br />C0nforr0a..nce with Plan. The Plat shall be developed pursuant to the final plat <br />consisting, of (__) sheets, prepared by , entitled Chestnut Hill <br />5th Addition. <br /> <br />.lncorpo~ati0n. of' All C.itv Code Requirement.,/. That the recitals above and the <br />provisionl; of the City Charter, Subdivision Code, Zoning Code and Public Improvement <br />Code of the CITY, as amended to date hereof, are in.corporated herein by reference. <br /> <br />Stage I ;Imt>rovements Reouired, The DEVELOPER agrees to construct the <br />required SCge I Improvements according to the terms and conditions of this contract and in <br />accordance with DEVELOPERS' plans submitted to the CITY. The DEVELOPER <br />shall sub,it a drainage and grading plan to the City Engineer pr/or to commencing any <br />grading ae~vity. The final construction plan for sanitary sewer, storm sewer, watermain, <br />and street improvements shall be submitted to the City Engineer for review and approval <br />prior to cortstruction. The DEVELOPER shall also be responsible, at its expense, for <br />installation of gas, telephone, and electric utility improvements. Street lights are the <br />responsibility of the DEVELOPER, however, the CITY will arrange for their installation <br />as a Stage II Improvement. The DEVELOPER shall be responsible for completing the <br />rough grading and providing lot corner stakes prior to the installation of underground <br />utilities. <br /> <br />Boulevard: and Area Resl~oration. The DEVELOPER shall be responsible for the <br />cost of esta~l!shing seed or sod in all boulevards within thirty (30) days of the completion <br />of the street ~mprovements, and restoring all other areas disturbed by the development <br />grading ope~don in accordance with the approved erosion and sediment control plan. The <br />DEVELOP]~R shall also be responsible for the cost of cleaning any soil, earth or debris <br />from the wetlands within and adjacent to this Plat resulting from grading performed in the <br />developmeni of the land. Any silt fencing utilized in the project for erosion and <br />sedimentation control shall be removed within twelve (12) months of the CITY'S <br />acceptance of the Stage I Improvements. <br /> <br /> <br />
