! V. <br /> <br />PARK DEDICATION: <br /> <br />16. Lnnd_.gknd Cash Contribution. Park dedication shall, in part, be satisfied by the <br />DEVELOPER dedicating for public use, the park trail as shown on the final plat. The <br /> dedication of park trail shall satisfy ......% of the park dedication due on the Plat. In <br /> accordance with the Chestnut Hill Development A~eement, the amount of park dedication <br /> cash payment due on each lot in the Plat is $215.15. Therefore, the cash payment shall be <br /> in the amount ors_ (17 tots x 2t5.15 x L %). <br /> <br />GENERAL <br /> <br />lT.Tre¢ Prcservafi0n and Pl.,qnlin~ Plan/Sofl. ded. Boul.~vi!.rO$, In accordance with <br /> City Code and the policy established by the City of Ramsey Park and Recreation <br /> Commission on June 10, 1993, the DEVELOPER is required to sod boulevards and <br /> submit a Landscape Plan for CITY approval that identifies existing tree ~owth within the <br /> Plat that will be preserved during construction and new plantings. It is herein ag-reed that <br /> the requirement for a Landscape Plan shall be fulfilled by the DEVELOPER as follows: <br /> <br />a) <br /> <br />Minimizing the impact of construction on trees in accordance with Minnesota <br />Extension Service publication "Protecting Trees From Construction Damage" <br />(Publication #NR-FO-6135-s). <br /> <br />b) <br /> <br />Plaming one two-inch diameter tree (or equivalent thereof) of an approved species <br />at the road frontage or in the front yard and sodding the boulevards of each of the <br />lots in the Plat prior to the issuance of a Certificate of Occupancy. In the event the <br />weather is not conducive to tree or sod planting at the time of Certificate of <br />Occupancy, the Building Permit holder shall place a cash deposit in the amount of <br />$200.00 for trees and $100.00 for sod in an escrow account with the CITY and <br />upon verification of the planting being accomplished, said cash deposit shall be <br />refunded to the Building Permit holder. Failure of the Builder to comply with the <br />planting requirement within a reasonable time frame following a determination by <br />the CITY that weather conditions are conducive To planting shall give the CITY <br />authority to cause the planting, the cost of which shall be charged to the escrow <br />account and the Builder shall not be eligible for a refund of the cash deposit made <br />for this purpose. <br /> <br />18.Tree Disease Prevention and Disposal, The DEVELOPER shall prevent the <br /> introduction and spread of tree disease into the residual tree populations of the Plat and <br /> adjoining properties and reduce the impacts of construction on the residual property of the <br /> Plat and adjoining properties. The DEVELOPER in order to accomplish this shall: <br /> <br />Install physical barriers, such as snow fence, around trees that are to remain. The <br />fencing shall be located at the dripline of these remaining trees. <br /> <br />Insure that ali equipment operators will have readily available, a tree wound <br />dressing and will apply it immediately to damaged oak trees if wounding occurs <br /> <br /> <br />
