Councilmember <br />adoption: <br /> <br />introduced the following resolution and moved for its <br /> <br /> RESOLUTION #94-08- <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT # RELATING TO A <br />REQUEST FROM GORDON HICKS FOR A CONDITIO~"~L USE PERMIT TO <br />STORE COI~'IMERCIAL EQUIPMENT IN AN R-I RURAL RESIDENTIAL <br />DISTRICT <br /> <br /> WHER~EAS, the City of Ramsey received an application from Gordon Hicks for a <br />conditional use permit to store commercial equipment in the R-1 Rural Residential District on the <br />property generally known as 16340 Nowthen Blvd. N.W. and legally described as follows: <br /> <br /> That pm of the East 1/2 of the Northwest 1/4 of Section 15, Township 32, Range 25, <br /> describe~ as follows: Beginning at a point in the East line of said Northwest 1/4 distant <br /> 1695 feei North of the Southeast comer of said Northwest 1/4; thence West at fight angles <br /> to said El~st line of the Northwest 1/4, a distance of 288 feet; thence at a right angle South a <br /> distance .of 150 feet; thence at a fight angle West to the intersection with the East kine of the <br /> West 30-O feet of said East 1/2 of the Northwest 1/4; thence Northerly, along said East line <br /> of the Wt:st 300 feet of the East 1/2 of the Northwest 1/4 to the intersection with the South <br /> line of th.~ North 800 feet of said East 1/2 of the Northwest 1/4; thence Easterly along said <br /> South linje of the North 800 feet of the East 1/2 of the Northwest 1/4 to the East line of said <br /> Northwegt 1/4; thence Southerly along said East line of Northwest 1/4 to the point of <br /> be~nning. Subject to highway easement for County Road No. 5 over the East 75 feet <br /> thereof. <br /> <br />NOW <br />CITY <br />findin <br /> <br /> Subject tO restrictions, reservations and easements of record, if any. <br /> <br /> (the "Subject Property") <br /> <br /> THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE <br /> OF R.4.MSEY, ANOKA COUNTY, STATE OF MINNESOTA that the <br />=os of fact relating to the request are determined to be as follows: <br /> <br /> That Gordon Hicks, hereinafter referred to as "Applicant"~ has properly applied for a <br /> conditional use permit to store a commercial vehicles and equipment in the R-1 Rural <br /> Residentiid District <br /> <br />That the .Spplication is pursuant to a court order resulting from a zoning violation of a <br />commerci'.al business operation in a residentially zoned disrricu <br /> <br />That the .zpning violation was initiated by a complaimt to City Staff of a commercial asphalt <br />operation being conducted on the subject property. <br /> <br />That the ~pplicant appeared before the Planning and Zoning Commission for a public <br />hearing pursuant to Section 9.03.04 (Conditional Use Permits) on August 2, 1994 and that <br />said publi[ hearing was properly advertised and that the minutes of said public hearing are <br />hereby indorporated by reference. <br /> <br />That the subject property is zoned R-1 Rural Residential and is approximately 9.7 acres in <br />size. <br /> <br />6. That the surrounding properties are also zoned R-1 Rum/Residential. <br /> <br /> <br />
