SEP 88 '94 02:2~ R~HD~LU DEH~GOODR~CH P.476 <br /> <br />The Warranty Deed attached hereto as Exhibit <br />"D" and by this reference made a part hereof <br />conveying to the CITY without restriction or <br />covenant a parcel of land approximately 50 <br />acres lying approximately 400 feet north of the <br />Anoka Landfill facility and reserving therein <br />certain rights for the excavation and <br />extraction of soil materials from said parcel. <br /> <br />4. WM]41 agrees for the benefit of the CITY to: <br /> <br />Make no further claims or demands from the CITY <br />for the use by the CITY of certain of W~fMI's <br />property for wetland mitigation, te2mporary <br />construction and/or permanent easements <br />required by the previous construction of 153rd <br />Avenue hTW across WMMZ property, identified as <br />City of Ramsey Improvement Project 89-4, Parcel <br />16. <br /> <br />Grade ~hose areas of the Alternate Recreational <br />Parcel as designated by the CITY, such that <br />said areas are level and capable of being used, <br />without additional soil corrections grading or <br />seeding, for recreational purposes such as <br />soccerball fields, softball fields. <br /> <br />Restore any areas of the Altermate Recreational <br />Parcel disturbed by W/~MI in relation to its <br />borrow activities on said parcel-by completion <br />of all final grading and soil corrections and <br />install top soil and re-establish turf on said <br />areas. <br /> <br />Within 30 days of execution of this Agreement, <br />prepare and submit to the MPCA all documen- <br />tation and filings necessary in order for the <br />MPCA to review and act on releasing the <br />properties described in Paragraph 2 above from <br />State of Minnesota environmental liens and to <br />permit that portion of the real properties <br />transferred herein lying south of the 153rd <br />Avenue ArW right of way to be used for active <br />recreational and/or residential purposes and <br />for that portion lying north of 153rd Avenue <br />NW right of way to be used .for residential <br />purposes. <br /> <br />5. This agreement is contingent upon.the CITY receiving from <br /> <br />the MPCA an unconditional release of any State of Minnesota <br /> <br /> <br />
