SEP 88 '94 02:2~ R~HD~LU DEH~GOODR~CH P.476 The Warranty Deed attached hereto as Exhibit "D" and by this reference made a part hereof conveying to the CITY without restriction or covenant a parcel of land approximately 50 acres lying approximately 400 feet north of the Anoka Landfill facility and reserving therein certain rights for the excavation and extraction of soil materials from said parcel. 4. WM]41 agrees for the benefit of the CITY to: Make no further claims or demands from the CITY for the use by the CITY of certain of W~fMI's property for wetland mitigation, te2mporary construction and/or permanent easements required by the previous construction of 153rd Avenue hTW across WMMZ property, identified as City of Ramsey Improvement Project 89-4, Parcel 16. Grade ~hose areas of the Alternate Recreational Parcel as designated by the CITY, such that said areas are level and capable of being used, without additional soil corrections grading or seeding, for recreational purposes such as soccerball fields, softball fields. Restore any areas of the Altermate Recreational Parcel disturbed by W/~MI in relation to its borrow activities on said parcel-by completion of all final grading and soil corrections and install top soil and re-establish turf on said areas. Within 30 days of execution of this Agreement, prepare and submit to the MPCA all documen- tation and filings necessary in order for the MPCA to review and act on releasing the properties described in Paragraph 2 above from State of Minnesota environmental liens and to permit that portion of the real properties transferred herein lying south of the 153rd Avenue ArW right of way to be used for active recreational and/or residential purposes and for that portion lying north of 153rd Avenue NW right of way to be used .for residential purposes. 5. This agreement is contingent upon.the CITY receiving from the MPCA an unconditional release of any State of Minnesota
