Th% Warranty Deed attached hereto as Exhibit "D~' and by this reference made a part hereof conveying to the CITY without restriction or covenant a parcel of land approximately 50 ac~es lying approximately 400 feet north of the An~ka Landfill facility and reserving therein certain rights for the excavation and ex~raction of soil materials from said parcel. Th~ Warranty Deed attached hereto as Exhibit "E'~ and by this reference made a part hereof conveying to the City without restriction or cogenant that parcel of land described on said Exhibit "E" and having Anoka county PIN 22-32- 25~13-0022. WMMI agrees for the benefit of the CITY as follows: Tolmake no further claims or demands from the CItY for the use by the CITY of certain of WM~.I's property for wetland mitigation, temporary construction and/or permanent easements required by the previous construction of~ 153rd Avenue NW across WMMI property, identified as City of Ramsey Improvement Prdject 89-4, Parcel 16. ToI grade those areas of the Alternate Redreational Parcel as designated by the CITY, sudh that said areas are level and capable of being used, without additional soil corrections grading or seeding, for recreational purposes such as soccerball fields, softball fields. To ~ restore any areas of the Alternate ReQreational Parcel disturbed by WMMI in rel~ation to its borrow activities on said parcel by completion of all final grading and so~l corrections and install top soil and re- es~ablish turf on said areas. Wi%bin 30 days of execution of this Agreement, W~I shall prepare and submit to the MPCA all doqumentation and filings necessary in order fo~ the MPCA to review and act on releasing the properties described in Paragraph 2 above from St~e of Minnesota environmental liens and to 3
