Warner, P.E., Division Manager of the <br />Groundwater* and Solid Waste Division of the Minnesota Pollution <br />Control Age:icy. Mr. Warner's letter makes clear that the MPCA is <br />opposed to ;he use of the closed Anoka Regional Sanitary Landfill <br />as a ski hill. <br /> <br /> Pursuant to Section 5.02 of the Development Agreement entered <br />into betwee~ the City of Ramsey and Waste Management, if Waste <br />Management ~as completed the landfill but does not construct the <br />ImprovementS, i.e., the Ski Hill and related facilities, because <br />the condition set forth in 4.02(d) has not been met, then Waste <br />Management agrees, at the request of the City, to convey to' the <br />City fee ~itle. to the Alternate Recreational Parcel. The <br />requirementiin Section 4.02(d) is that Waste Management shall have <br />received approval from the MPCA to operate the Recreational Parcel <br />as a Ski Hill. As indicated in Mr. Warner's letter, such approval <br />will not be~granted. <br /> <br /> Based iupon the Development Agreement, Waste Management <br />requests that the City determine whether it wishes to request <br />conveyance ~f fee title to the Alternate Recreational Parcel as <br /> <br />227028.1 <br /> <br /> <br />
