WHEREAS, the DEVELOPER desires to construct the Stage I and Stage II <br />improvement% ~xcept for those Stage II Improvements constructed by the CITY. <br /> NOW, 'I~HEREFORE, the CITY and DEVELOPER agree as follows: <br /> <br /> STA~E I IMPROVEMENTS AND FINANCIAL GUARANTEES. <br />1. C~ity Code Comolianee. That the DEVELOPERS will develop the Plat in <br /> ad:cordance with the City Code, Section 9.50, entitled "Subdivision" <br /> <br />2. Ctonformanee with Plan. The Plat. shall be developed pursuant to the final <br /> plat consisting of two (2) sheets, prepared by Bradley J. Canaday Surveying. <br /> <br />3. Iacor_0oration of All City Code Requirements. That the recitals above and <br /> th~ provisions of the City Charter, Subdivision Code, Zoning Code and Public <br /> Ix~provement Code of the CITY as amended to date hereof, are incorporated herein <br /> b~ reference. <br /> <br />4. S~_ee I Improvements Required. The DEVELOPER agrees to construct the <br /> re~luired Stage I Improvements according to the terms and conditions of this <br /> cc~ tract and in accordance with DEVELOPERS' plans submitted to the CITY. <br /> S~,'d plans shall be in general conformance with the Grading and Erosion Control <br /> Pl.lm prepared by Gerald Floden, P.E., dated July 19, 1994. <br /> <br />5. Bt~[evord and Area R¢$t0rati0n. The DEVELOPER shall be responsible <br /> ioff the cost of establishing seed or sod in all boulevards within thirty (30) days of <br /> th~, completion of the street improvements, and restore all other areas disturbed by <br /> that development grading operation in accordance with the approved erosion and <br /> sexliment control plan. The DEVELOPER shall also be responsible for the cost of <br /> cleaning any soil, earth or debris from the wetlands within and adjacent to this Plat <br /> re.~ulting from grading performed in the development of the land. Any silt fencing <br /> uti~zed in the project for erosion and sedimentation control shall be removed within <br /> twelve (12) months of the CITY'S acceptance of the Stage I Improvements. <br /> <br />6. Requirements after Street Surfaeine After the street surfacin~ is installed <br /> theiDEVELOPERS shall clear any soil, earth, or debris from the streets and from <br /> theilots within the Plat resulting from any construction on the Subject Property by <br /> thelDEVELOPERS or their successors and assigns. <br /> <br />7. Reinoval of Debris. The DEVELOPER shall be responsible for the r~moval <br /> ana~ proper disposal of all debris, garbage, fallen trees and abandoned building <br /> fouhdations from the Subject Property. <br /> <br /> Sta,~e 1 Imt)rovements - Comoiet~on Date.
