No building permit for any lot in the l~at-shall be issued until (a) vehicular access to the lot is provided including the ir~stallation of Class V material on all streets in the Plat; (b) a Certificate of Survey i~cluding that information required by the CITY has been supplied to thc Building Official; and (c) all financial guarantees required by the CITY have been satisfied. PARK DEDICATION: phrk Dedication. In accordance with thc May 9, 1989 D~lication Agreement, there is no park dedication due on the Plat. GENERAL Northfork Park T~,ee Preservation and Planting Plan. In accordance with City Code and the pcticy established by the City of Ramsey Park and Recreation Commission on June 1 1993, the DEVELOPER is required to submit a Landscape Plan for CITY ap ~roval that identifies existing tree growth within the Plat that will be preserved du lng consumction and new plantings. It is herein agreed that the requirement for a L~dscape Plan shall be fulfilled by the DEVELOPER as follows: a) ~ Minimizing the impact of consumction on trees in accordance w/th ~ Minnesota Extension Service pubhcarion Protecnng Trees From Construction Damage" (Publication ~.NR-FO-6135-S). b) Planting one two-inch diameter tree (or equivalent thereof) of an approved species at the road frontage or in the front yard of each of the lots in the Plat prior to the issuance of a Certificate of Occupancy. tn the event the : weather is not conducive to tree planting at the time of Certificate of Occupancy, the Building Permit holder shall place a cash deposit in the ~ amount of $200.00 for trees in an escrow account with the CITY and upon i verification of the planting being accomplished, said cash deposit shall be refunded to the Building Permit holder. Failure of the Builder to comply with the planting requirement within a reasonable time frame folio.wing a determination by the CITY that weather conditions are conducive to planting shall give the CITY authority to cause the planting, the cost of ~ which shall be charged to the escrow account and the Builder shall not be eligible for a refund of the cash d.,eposit made for this purpose. .Tre .~ Disease Prevention. The DEVELOPERS shall prevent the introduction and spread of tree disease into the residue tree populations of the Plat and adjoining prop. erdes and reduce the impacts of construction on the residual property of the Plat' and adjoining properties. The DEVELOPERS in order to accomplish this sh~ ao Install physical barriers such as snow fence, around trees that are to remain. The fencing shall be located at the driptine of these remaining trees.
